ORDI~ANCE NO, 1834 ,By Mrs. Waitt .AN ORDINANCE determining to proceed with~ and levying and assessin~ ? special tax to pay the cost and exDense of improving Lakewood ~eights Boulevard from Carabell Avenue to ~lger Road by paving same with brick or bituminous concrete, or sheet asphalt, or cement concrete, doing any and all grading, draining and curbing, incidentaland necessary thereto, and authorizing the Mayor and DireCtor of Finance to issue bonds in the sumof $33,580.00 in anticipation of said special tax to provide a fund to pay the portion of the cost and expense of said improvement for which said special tax is levied. BE IT ORDAINED by the Council of the City of Lakewood, State of Ohio, three-fourths of all members thereof concurring: Section l: That it is hereby determined to proceed with the.improve- ment of Lakewood Heights Boulevard from Car&bell Avenue to Alger Road by paving same with brick or bituminous concrete, or sheet asphalt, or cement concrete, doing any and all gr&d~ng, a~d curbing incidental and necessary thereto. in accordance with Resolution No. 1898 passed Nay 2, 1931 a~d in accordance with plans, specifications, estimates and profiles here° ~tofore approved and now on file in the office of the Director of Public Works. Section 2: That all claims for damages resul.ting from said improve- ment shall be judicially inquired into after the completion thereof, and that the Director of Public Works be and he is hereby authorized and directed to enter into contract for said improvement in the manner provided by law, which improvement, in accordance with Article 15, Section 16 of the Charter has been estimated by the Director of Public Works to have a life of 20 years. Section 3: That for the purpose of Spaying the cost and expense of said ~mprovement there is hereby levied and assessed a speczal tax upon the several lots.and parcels of land design~:ted in and in accordance w~th Estimated Assessment No. ~85 as made for that purpose by the Director of Finance and recommended to this Council by the Board of Revision of Assessments. Said estimated assessment was made on the basis of special benefits conferred by said improvement on the several parcels of land therein described and the same is herein confirmed, adopted and approved. Section 4: That the owners of the several lots or parcels of land in- cluded in said assessment shall pay the amounts from them severally due as shown by Column No. 3 of said Estimm%e~d Assessment No, 485 ~o the City Treasurer on or before thirty days from ~he date of the passage of this ordinance, at their option, and ~n def. eult thereof said special assessment with interest at the ra~e of 6 per centum per annum, upon deferred payments, shall be payable to the County Treasurer in l0 annual installments with the regular taxes of 1922 to 1931 both inclusive, Section 5: That to provide a fund for the ~y~eat .~ the portiion of the cost and expense for which the special as~.~ent herein is levied for said improvement. The Eayor and Director of Finance be and they are hereby authorized to issue l0 bonds of the City of Lakewood, Ohio in ~he aggregate sum of $33,~80.00 of which bonds one bond in the sum of 3,358.00 shall be due and payable on October l, 1923 and one bond in the sum of $3,358.00
