0RDI!~ANCE NO. 183~ By Mrs. Knirk .AN ORDINANCE determining to proceed with, and levying and assessin~ ~ special tax to pay the cost and.expense of improvingLakewoOd Heights Boulevar~ from Kyle Avenue to Rlv~wide Road by paving same with b~ick or bituminous concrete or sheet asphalt, or cement concrete, doing any and~all grading, draining and curbing incidental and necesss~ry thereto, and authorizing the Mayor and Director of Finance to issue bonds in the sum o~f $41,740.00 in anticipation of s&id special tax to provide a fund to pay the portion of the cost and expense of said improvement for which said special tax is levied. BE IT ORDAINED by the Council of the City of Lakewood, Ste~e of Ohzo, three-fourths of all members thereof concurring: Section 1: That it is hereby determined to proceed with the improve- ment of Lakewood Heights Boulevard from Kyle Avenue to Riverside Road by paving same with brick or bituminous concrete or sheet asphalt, or cement concrete, doing any and all grading, draining and curbing in- cidental and necessary thereto. in accordance with Resolution No. 1922 passed July 18, 1921 a~d in accordence with plans, specifications, estimetes and profiles here- tofore approved and now on file in the office of the Director of Public Works, Section 2: That all claims for damages resulting from said improve- ment sh~ll be judicially inquired into after the completion thereof, and that the Director of Public Works be and he is hereby authorized and directed to enter into contract for sa. id improvement in the manner ~rovided by law, which improvement, in accordance with Article Section 16 of the Charter'has been estimated by the Director of Public Works t~o have a life of 20 years. Section 3: That for the purpose o~paying the cost and expense of said improvement there is hereby levied and assessed a speczal t~x upon the several lots and parcels of l~nd desmgn~ted in and in accordance with Estimated Assessmenm No. 486 as made for that puroose by the Director of Finance and recommended to this Council by the Board of Revision of Assessments. Said esti~ted ~ssessment was made on the basis of special benefits conferred by said improvement on the several parcels of land therein described and the same is here~n confirmed, adopted and.approved, Section 4: That the owners of the several lots or parcels of land in- cluded in said assessment shall pay the amounts from them severally due as shown by Column No. ~ of said Estin~te~i Assessmen~ No. 486 to the City Treasurer on or before thirty days fro~ ~he date of the passage of this ordinance, at their option, and in def~ult thereof said special assessmen~ with interest at the ra~e of 6 per centum per annum, upon deferred payments, shall be payable to the County Treasurer in l0 annual installments with the regular taxes of 1922 to 1931 both inclusive. Section 5: That to provide a fund for the ~y~nt ~g the portiion of the cost and expense for which the special msses~.~,nt herein is levied for said improvement, The Mayor and Director of Finance be snd they are hereby authorized to issue lO bonds of the City oi Lakewood, Ohio in the aggregate sum of $41,740.00 of which bonds one bond' in the sum of $4,174.00 shall be due and payable on October l, 1923 and one bond in the sum of $4,174.00
