, 0RDII~ANCE NO. 18S7 By Mr. Gormsen AN ORDINANCE determining to proceed with, and levying and assessin~ ~ spec&al tax to pay the cost s;nd expense of ~mproving Overbrook Avenue from Riverway Avenue to Indianola ~venue by paving same wit~ brick or bituminou~concrete or sheet asphalt, or cement concrete, doing any and all grading, draining and curbing and installing necessary cmrb connec- tions and authorizing the Mayor,and ~Directcr of Finance to issue bonds in She sum cf $12,S50.00 in anticipation of said special tax to provide a fund to pay the portion cf the cost and expense of said improvement for which said special tax is levied. BE ~T ORDAINED by the COuncil of the City of Lakewood, State of Ohio, three-fourths of all members thereof concurring: Section 1: That it is hereby determined to proceed With the improve- ment cf O~erbrook Avenue from RiverWay Avenue to ~ndianola Avenue by a · p v~ng same with brick or bituminous concrete or sheet asphalt, or cement concrete, doing any and all grading, draining and curbing and installing necessary curb connectione.~? ..... ~,'-~? in accordance with Resolution No, 1948 passedDecember 19~,1921 a~d in accordance with plans, specifiSations, e~timetes and~prcfmles here~. ~0fore approved and now on file i~ the office of the Director of Pub2ic ~0 rks. section 2: That all claims for de~nages resulting from said improve- ment shall~be judicially inquired into after the completion thereof, and that the Director of Public i~Yorks be and he is hereby authorized and directed to enter into contract for s~.id improvement in the manner provided by law, which improvemen$~ in accordance with Article Section 16 of the Charter' has been estimated by the Director of ~ublic Works to h~ve a life of 20 years, Section ~: That for the purpose o~paying the cost and expense of said improvement there is hereby levied and assessed a special tax upon the several lots and parcels of l~~nd ~esign~ted in and in accordance with Estimated AsSessment No. 489 as m~de for that purpose by the Director of Finance and'recommended to this Council by the Board of Revision of Assessments. Said estims~ted assessment was made on the basis of special benefits conferred by said improvement on the several parcels cf land therein described and the. s~me is herein confirmed, -adopted and approved, Section ~: That the owners of the several lots or parcels of land in- cluded in said assessment shall pay the amounts from them severally due as shown by Column No. ~ of sa~d Estin~te~i Assessment No.489 to the. City Treasurer on or before thirty days from~ ~he date of the passage~ this ordinsnce, at their option, a~d in' dof~ult thereof ssmd specxal assessment with interest at the r~te of 5~ per centum per annDun, upon deferred payments, shall be payable to the County Treasurer ih l0 annual installments with the regular taxes of 1922 t0~ 19~l bo~h inclusive, Section ~: That to provide a fund f~r the ~'~y~n~ .~'~ the pO:~tiion of ~.sses~.~s~ t herein is levied the cost and expense for which the special ~ for said improvement, The Ea~y~or sn~ Di~sct0r cf ~mn~nce be and they are hereby authorized to issue ~? bond~ of ~he City of Lakewood, Ohio in the aggregate sum of $12,S%0.00 of which bonds one bond in the sum of $1,2S5.00 sh~ll be due and payable on October l, 192S and one bond in the sum of $1,2~.00
