0RDI~NCE N0.1852 By Mr. Gormsen AN 0RDIi~NCE determining to proceed With, and levytn and assessin~ ~ special tax to pay the cost and eXOenSe ~f imprOvinmlerle AVenue from J~ckson Avenue tc Giel AVenue by pa~ving Same with b~ick cr bituminous concrete, or sheet asphalt, er.aSphalt b~cck, er bitulithic, or Cement concrete, doing any and all grading, draining and~curbing and ConStructing curb connections incidental and necessary thereto$ and authorizing the Mayor and Director of Finance tc issue bonds in the sum of $3,~02.~0 in anticipation of Said special tax to provide a fund tc pay the portion of the cost and expense cf said improvement for which said special tax is levied. BE IT ORDAINED by the Council of the City of Lakewood, State of Ohio, three-fourths of all members thereof concurring: Section l: That it's hereby determmned to proceed with the improve- ment of Merle Avenue fr~m Jackson'Avenue ~o ~ieI Avenue by paving same with brick or bituminous concrete; or sheet asphalt, or asphalt block, or bitulithic, or cement concrete, doing any and all grading, draining and curbing incidental and necesary thereto. in accordance with Resolution No. 1974 passed March 6, 1922 and in accordance with plans, specifications, estimetes and profiles here~ torero approved and now on file in the office of the Director of Public Works. S~ction 2: That all claims for damages resulting from said improve- ment shall be judicially inquired into afteF the completion thereof, and that the Director of Public Works be and he is hereby authorized and directed to enter into contract for said improvement in the manner ~ro~ded ~y law, which mmprovement, in accordance with Artic~le i , ~ectmon 16 of the Charter has been estimated by the Director of ~ublic Works to have a life of 20 years. Section 3: That for the purpose o~'~paying the cost and expense of said improvement there is hereby levied and assessed a special tax upon the several lots and parcels of land designated in and in accordance with Estimated Assessment No. 496 as made for that purpose by the Director of Financ~ and recommended to this Council by the Board of Revision of Assessments. Said estimated assessment was made on the basis of special benefits conferred by said improvement on the several parcels of land therein described and the same is here~n confirmed adopted and approved. , Section ~: That the owners of the several lots or parcels of land in- cluded in said assessment shall pay the amounts from them severally due as shown by Column No. ~ of said Estin~te~ Assessment No.496 to the Citx Treasurer on or before thirty days from ~he date of the passage of this ordinance, at their option, and in default thereof ssid special assessment with interest at the ra~e of 5~ per centum per annum, upon deferred payments, shall be payable to the County Treasurer in'9 annual installments with the regular taxes of 1922 to 1930 both inclusive. Section %: That to provide a fund for the B>~y~at .~ the portiion of the cost and expense for which the special asses~.~snt herein is levied for said improvement, The ~gayor and Director of Finance be and they are hereby authorized to issue ~ bonds of the City of Lakewood, Ohio in the aggregate sum of $3,402.00 of which bends one bond in the sum of $378.00 shall be due and payable cn October l, 192~ and one bond in the sum of $378.00
