0RDI~NCE N0.1852 By Mr. Gormsen <br />AN 0RDIi~NCE determining to proceed With, and levytn and assessin~ ~ <br />special tax to pay the cost and eXOenSe ~f imprOvinmlerle AVenue from <br />J~ckson Avenue tc Giel AVenue by pa~ving Same with b~ick cr bituminous <br />concrete, or sheet asphalt, er.aSphalt b~cck, er bitulithic, or Cement <br />concrete, doing any and all grading, draining and~curbing and ConStructing <br />curb connections incidental and necessary thereto$ and authorizing the <br />Mayor and Director of Finance tc issue bonds in the sum of $3,~02.~0 in <br />anticipation of Said special tax to provide a fund tc pay the portion of <br />the cost and expense cf said improvement for which said special tax is <br />levied. <br /> <br /> BE IT ORDAINED by the Council of the City of Lakewood, State of Ohio, <br /> three-fourths of all members thereof concurring: <br /> <br />Section l: That it's hereby determmned to proceed with the improve- <br />ment of Merle Avenue fr~m Jackson'Avenue ~o ~ieI Avenue by paving same <br />with brick or bituminous concrete; or sheet asphalt, or asphalt block, <br />or bitulithic, or cement concrete, doing any and all grading, draining <br />and curbing incidental and necesary thereto. <br /> <br />in accordance with Resolution No. 1974 passed March 6, 1922 and <br />in accordance with plans, specifications, estimetes and profiles here~ <br />torero approved and now on file in the office of the Director of Public <br />Works. <br /> <br />S~ction 2: That all claims for damages resulting from said improve- <br />ment shall be judicially inquired into afteF the completion thereof, <br />and that the Director of Public Works be and he is hereby authorized <br />and directed to enter into contract for said improvement in the manner <br />~ro~ded ~y law, which mmprovement, in accordance with Artic~le i , <br />~ectmon 16 of the Charter has been estimated by the Director of ~ublic <br />Works to have a life of 20 years. <br /> <br />Section 3: That for the purpose o~'~paying the cost and expense of said <br />improvement there is hereby levied and assessed a special tax upon the <br />several lots and parcels of land designated in and in accordance with <br />Estimated Assessment No. 496 as made for that purpose by the Director <br />of Financ~ and recommended to this Council by the Board of Revision <br />of Assessments. Said estimated assessment was made on the basis of <br />special benefits conferred by said improvement on the several parcels <br />of land therein described and the same is here~n confirmed adopted <br />and approved. , <br /> <br /> Section ~: That the owners of the several lots or parcels of land in- <br /> cluded in said assessment shall pay the amounts from them severally <br /> due as shown by Column No. ~ of said Estin~te~ Assessment No.496 to the <br /> Citx Treasurer on or before thirty days from ~he date of the passage of <br /> this ordinance, at their option, and in default thereof ssid special <br /> assessment with interest at the ra~e of 5~ per centum per annum, upon <br /> deferred payments, shall be payable to the County Treasurer in'9 <br /> annual installments with the regular taxes of 1922 to 1930 both <br /> inclusive. <br /> <br />Section %: That to provide a fund for the B>~y~at .~ the portiion of <br />the cost and expense for which the special asses~.~snt herein is levied <br />for said improvement, The ~gayor and Director of Finance be and they are <br />hereby authorized to issue ~ bonds of the City of Lakewood, Ohio in <br />the aggregate sum of $3,402.00 of which bends one bond in the sum of <br />$378.00 shall be due and payable cn October l, 192~ and one bond in the <br />sum of $378.00 <br /> <br /> <br />
