Knits ~.iJ ORDINANCE determining to proceed with, and levying and assess~..~? p czal tax to pay t. he cost and expense o,f improving Esther Avenue' Al~_jer Road to Mars (AmCk~ar)Avenue by laying wa~.er main of six inch from ' ~ c~st iron pipe therein with necessary valves, hydrants, and other appurtenances incidental thereto, and aut;~orzz~ng the ~:~[ayor and Director of Finance to issue bonds in the sum of $2,1~5%00 in anticipation of the collection of said special tax to provide a fund for the payment of the portion of the cost and expense of said improvement for which said special tax is levied. BE IT ORDAINED by the Council of the City of Lakewood, State of 0hio, three-fourths of all members thereof concurring: Section l: That it im hereby determined to proceed with the 'improve- ment of Esther Avenue from Alger Road to Ears (Andmam) Avenue by laying Water main of six inch cast ~on pipe therein with necessary valves, ~drants, and other appurtenances incidental thereto. in accordance with Resolution No. 2006 .~ passed APril 24, 1922 and in accordance with plans, specificationsi estimates and profiles here- tofore approved and now on fi~e in the office cf the Director of Public Works. section 2: That ail claims for damages resulting from said improve~ ment Shall be judicially inquired into after the cOmPletion thereof~ and that the Director of Public Works be and ~e is hereby authorized and directed to enter into contract for said improvement in the manner ~ro~$ded ~y law, Which improvement, in accordance with Article 15, ec~on 16 of the Charter~has been estimated by the Director of Public Works to have a life of 20 years. Section ~: That for the purpose o~ paying the cost and expense of said improvement there is hereby levied and assessed a special tax upon the several lots and parcels of iand designated in and in accordance with Estimated Assessment No~ 507 as made for that purpose by the Director of Finance and recommended to this Council by the BOard of Revision ~f Assessments. Said estimated assessment was made on the basis of special benefits conferred by said improvement on the several parcels of land therein described and the ss~e is herein confirmed, adopted and approved~ Section ~: That the owners of the several l~ts or parcels of land in.- cluded in said assessment shall pay the amounts from them severally due as shown by ColUmn No, ~ of said Estim~te~d Assessment No, 507 to the City TreasUrer on or before thirty days from ~he date of the passage of this ordinance, at their option, and in default thereof said special assessment with interest at the rate of 5½per centum per annum, upon deferred payments, shall be payable to the County Treasurer ' annual installments With the regular taxes of 1922 to ~¢26~ botL. inclusive.
