DL~NCE N0, 1899 By Mr. Gormsen ~J ORDINANCE determining to proceed with~ and levying and assess~,~? ~pecial ta× to pay the Cost and expense of improving Franklin AvenGe from Highland Avenue to 1000t westerly by paving same with brick or ltum~nous c&ncrete, or sheet asphalt or cement concrete, doing any and all grading, draining and curbing inoiderr~l and necessary thereto, and a~thorlZing the Maysr ahd Director of FinanCe to issue bonds in the sum of $10,6~0.80 in anticipation of said tax to provide a fund to pay the portion of the cost and expense of &ai~ ~mprovement for which said special tax is levied. BE IT ORDAINED bY the Council of the City Of ~akewood, State of Ohio, three-f~urths of all members thereof concurring: Section 1:)' That ~it is hereby determined to proceed with the improve- ment of Franklin Avenue from Highland Avenue to 1000~ westerly by paving same with brick or bituminous concrete, or sheet asphalt or cement con- crete, do~g any and all grading, draining and curbing incidental and necessary thereto ed by Ordinance No. 18%S adopted April 17, 1922 and in accordance With Resolution No. 185S passed August l, 1921 ~$d amend- in accordance With plans, specifications, estim@tes and profiles here- tofore approved and now on file in the office of the Director of Public Works.~ Se~Ction 2~~ That all claims for damages resulting from said improve- ment shall be judicially inquired into after the completion thereof, and that the Directo~ of pUblic Works be and he is hereby authorizsd and directed to enter into contract for s~id imprOVement ~n the manner provided ~y law, which improvement,, in accordance with Article Section 16 of the Charter has been estimated bY the Director of Public Works to have a life of 20 years. Section 3:~ That for the purpose oX~paying the cost and expense of said improvement there is hereby levied and assessed a special tax upon the several lots and parcels of land desigrmted in and in accordance with Estimated Assessment No. ~00 as made for that purpose by the Director of Finance and recommended to this Council by the Board of Revision Of Assessments, Said estimated assessment was made on the basis of special benefits conferred by said improvement on the seVeral parcels of land therein described and the same is herein confirmed, adopted and appro~ed~ Section ~: That the owners of the several lots or parcels of land in. eluded in said assessment Shall pay the amounts from them severally due as shown by Column No~ 3 of said Estimated Assessment No. ~O0to the 0ity Treasurer on or before thirty days from {he date of the passage of this ordinance; at their option, and in def.~ult thereof said special assessment with interest at the rate of 6 per centum per annum, upon deferred payments, shall be payable to the County Treasurer in l0 annual installments with the regular taxes of 1~22 to 1931 botL inclusive. Section g: That to provide a fund for the ~'~y~nt ~,~ the pcrtiion of the cost and expense for which the special s. ssesc~.'~ent herein is levie~ for said improvement, The Mayor and Director of Z~inance be snd they aJ~ hereby authorized to issue 10 bonds of the City of L~kewoo~, Ohio in !e ~ggregate sum of $10,6~0.00 of which bondsone bond in the sum of ,06~.00 shall be due and Payable on October 1st each of the yeam 1923. 1931 inclusive and one bond in the sum of $1,06~,00 shall be due and payable on July l, 1932 at the
