<br />Section 3. (a)

<br />~otwithstanding any provisions of any ordinance ef
<br />
<br />prior date hereto, The East Ohio Gas Company shall, at its expense,
<br />extend ~ts pipes and mains for furnishing natural gas to and upon
<br />any present or future dedicated street, highway, avenue, alley,
<br />public ground, public place, or any part thereof, in the city of
<br />Lakewood, whenever at least one consumer on an average of each one
<br />hundred (100) feet of pipe in the street or streets, in which the
<br />extension is to be made shall first, in writing, agree to take a
<br />supply of natural gas at the then established rates; provided, however,
<br />that the Company shall not be required to make any extensions during
<br />the months of December, ~ January, February and March of any year.
<br /> Section 4. Preferences. If at any time during the term
<br />of this ordinance the company is unable to obtain a full supply of
<br />natural gas, the amount which the company does obtain shall be fairly
<br />apportioned among the municipalities which the said company is now
<br />under obligation to supply.
<br /> In the event of a shortage of the supply of natural gas, the
<br /> company shall, during the emergency, supply natural gas in an order
<br /> of preference based upon the following specifications:
<br /> First Class -- the domestic~ consumer; which shall include the users
<br /> of natural gas for such purposes as cooking, lighting and heating in
<br /> private homes, boarding houses and apartment houses; the users of
<br /> natural gas for lighting and cooking only in hotels, restaurants,
<br /> bakeries, eating places, club houses, public schools, parochial shhools,
<br /> private schools, hospitals and charitable institutions, and in places
<br /> of like kind, where the element of human welfare is the l~edomtnating
<br /> requirement.
<br />
<br /> And in addition, as belonging to said first class, shall be
<br /> included the following: ~her~ natural gas is being used in limited
<br /> quantities for scientific, experimental or mechanical purposes and
<br /> where other means of producing light and heat for such purposes cannot
<br /> be reasonably substituted, an amount essential to such use, but not
<br /> to exceed tenthousand (10,000) cubic feet per month to each consumer so
<br /> engaged, may be used for such purposes only, and as if they were
<br /> included in the class of domestic consumers herein specified.
<br /> ~econd Class - The industrial consumer. All other consumers
<br /> shall be classed as industrial consumers.
<br /> Records of the company showing the supply of natural gas and
<br /> how it'apportioned shall be open for inspection at all times to the
<br /> city through representatives duly authorized by Council.
<br /> Section 5. All meters shall be supplied by the company at
<br /> its own expense and shall be of a standard make. Each meter shall
<br /> be carefully tested by the company before setting on any consumer's
<br /> line and a record of such test made, and signed by th~ par~ making
<br /> the test, setting forth information as to the accurac~y of. such meter
<br /> together with all data taken at the time of n~king the test. Such
<br /> record shall be filed and kept for a period of three years and shall,
<br /> at all times, be open for examination by the Director of Public Works
<br /> or his representative. In addition ~o the foregoing, the city may,
<br /> upon request of any consumer, make a test of the accuracy of such
<br /> consumer's meter, in which case the city will so notify the gas
<br /> company who will, in the presence of a representative of the city,
<br /> disconnect said meter, installing another in its p~Aee. The meter to
<br /> be tested, after being sealed by a city representa~ve, shall be prompt1
<br /> removed by said company to the city's testing room. The consumer,
<br /> at the time of making the request, shall deposit with said city a fee
<br /> which shall be determined by the manufacturers' designated rating as
<br /> follows:
<br /> Meters of ten-light capacity or under -- or meters having a rated
<br /> capacity of 200 cubic feet per hour or under .... $2.00
