ORDINANCE NO. 3246 By Mr. Phillips <br /> <br />AN 0MDTNANCE providing for the payment of the claim of the City of <br />Cleveland against the City of Lakewood in an amount representing the <br />difference in the former and present rates for water sold to the City <br />of Lakewood f~om July 1st 1931 to Nov. 30th, 1951 for the new rate <br />and decla~ng an emergency. <br /> <br />~HEREAS, a dispute has existed between the City of Lakewood and the <br />City of Cleveland as eo the price and terms upon which the City of <br />Cleveland has and. will. furnish water to the City of Lakewood, and <br /> <br />WHEREAS, the parties are desirous of comDromising all their respec- <br />tive claims each against the other,..and settling all ma~rs, especially <br />the rate to be paid the City of Cleveland for water already furnished, <br />but not paid for, and for water to be fux~niahed during a period ending <br />June 30th, 19Al, by terminating the former contract as of June 30th <br />1931 and entering into a new contract. Said contract and the rate <br />therein fixed to be effective as of July 1st, 1951. Such payment <br />to be given and .received in full settlement of any and all claim~, <br />which said City of Cleveland may have against the City of LakewoOd <br />for water supplied to said City of Lakewcod to and including <br />November 30th, 1931. <br /> <br /> Therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEW00D, <br />STATE OF 0HI0, two-thirds of all members thereof concurring. ~ <br /> <br />Section 1. That the Director ef Finance be and he is hereby authorized <br />to pay to the City of Cleveland, an amount representing the difference <br />in the old and the new rates for water purchased by the City of Lakewood <br />from the City of Cleveland from July ist, 1931 to November 30th, I~Z1, <br />which amount represents a claim and covers the amount of the difference <br />between the two rates. <br /> <br />Section 2. As stated in the preamble, this ordinance ia declared to <br />be an emergency measure, and shall be in full force and effect upon <br />its passage and approval by the Mayor, and at the earliest period <br />allotted by law. <br /> <br />Adopted:.
