On <br />application in a specific case, the Council may after public notice and hearing issue <br />a conditional permit for the construction of a building beyond the building line <br />established by this section, provided the public health, safety, convenience or <br />general welfare will not thereby be injuriously affected or the appropriate use of <br />neighboring proper~y seriously injured. <br /> <br />be mended to read as follows~ <br /> <br />Sec%ion 21. FRONT YARDS, BUILDING LINES -~For the purpose of establishing front <br />yards a~d for the purpose of further regulating side yards and the heights of build- <br />ings near the street line, building lines,as set forth on the Building line map <br />which accompanies this ordiuance and is hereby declared to be part hereof, are hereby <br />established. The map designations and the map designation ruleswhich accompany said <br />map are hereby declared par~ thereof. Between a building line and the street line <br />no building or portion of a building, extending above the curb level, may be erected. <br /> <br />1. ANY USE DISTRICT <br />(a) Where, on any street frontage in any use district, a specific building line is <br />indicted on "The Building Line Map of Lakewood" which accomp=~es this ordinance <br />and is hereby made a part hereof, such Building line shall be the front yard line <br />for that street frontage. <br /> <br />(b) Where a specific building line ia indica~ed on the building line maps, but <br />where 60% or more of such frontage, between two intersecting streets is ~w~.roved <br />with buildings that are nearer the street line than such specified line, the ground <br />level story of a building may be eX%ended cut ~o the average line of the existing <br />Buildings cn et~her side thereof. <br /> <br />2. RESIDENOE DISTRICTS - In a Class la or lb district where ~he location of the <br />building line is not prescribed on the building line map, building lines are emtab- <br />lished as foll~ws~ <br /> <br />(a) On a street frontage on either side of a street where 50%, or more of suchfront- <br />age between ~wo intersecting streets, but excluding the frontage along the side <br />line of & corner lot or outside such Class la or lb district, is improved with <br />buildings %hat are set back from the street line or where all the buildings though <br />occupying less than50%butmore than 20%of such frontage are set back from the <br />street line, the alA~-~ent of the existing Buildings eh~ll~,b~ithe:jl~ilding lines <br />Minor irregularities in such ali~ment of existing buildings may be disregarded by <br />the Board of Zoning Appeals in defining and applying this building line regulation <br />or said Board may, when in its opinion the general purpose a~d intent of this para- <br />graph will be better served thereby, determine that the average distance the exist- <br />ing buildings are back from the street line, either for such entire frontage or for <br />~any par~ thereof, shall be the building lines <br /> <br />(b) cna street frontage on either side cf a street between t~vo intersecting streets, <br />but excluding the frontage along the side line of a ecrnar lot or outside of such <br />Class la or lb district where not more than20%cf such frontage is i~provedwith <br />buildings that are built at the street line and where the provisions of paragraph (1) <br />of this section do not create a building line the distance of the building line back <br />from the street line shall be 20% of the average or normal depth of the lots having <br />their front lines along such street frontage but such distance back rrna the street <br />line need not be more than 30 feet. Where in any portion of such street frontage <br />there are lots of markedly leas depth than the normal, the Board of Zoning Appeals <br />in defining and applying this building line regulation, may, when in its opinion <br />the general purpose and intent of this paragraph will be better served thereby, <br />divide such street frontage into sections for the application of ~he above 20% build- <br />ing line requirement. <br /> <br /> <br />
