ORDIN_~CE NO. 3771 <br /> <br />BY Mr. Thompson <br /> <br />~a~N O~?~DIi~f~WCE granting The Cleveland Railway Company the right to maintain an~ <br />operate motor coach lines in the City of Lakewood for the transportation of <br />passengers for hire and fixing the route, rates of fare, the duration of the <br />grant and other terms and conditions. <br /> <br />~P~AS, The Cleveland Railv~y Company, an Ohio, corporation, hereinafter so~ <br />times referred to as the "Company", for several years pursuant to informal <br />permits from the Council and Mayor of the City of Lakewood, hereinafter som~ <br />times referred to as the "City", has opera~ed motor coach lines i~ the,~ity <br />for the transportation of passengers for hire uoon two routes, (1) the ~ompan~ <br />so-called Rocky River - War~en line and (2) the-Company's so-called West ll?i <br />Street line, in each case as a part of the routes of said lines in the *ity <br />of Cleveland; and <br /> <br />~;~TtEREAS, the City and the~Company desire to confirm and reduce to a franchi~ <br />contract the right of the ompany ~o operate said motor coach lines in the <br />City of Lakewood~and ~o fix the terms and conditions thereof; <br /> <br />NOW, TI~EREFORE, BE IT 0RDAI1Q]sD by the Council of the City of Lal~vood, State <br /> U ° · <br />of Ohio, Zwo-thirds of all members thereof cono rr~ng. <br /> <br />Section lo <br /> <br />The Cleveland Railway Company is hereby grant ed, upon the terms <br />and conditions herein set f~rth, t~ right until the first day <br />of May, 19~4, and thereafter so long as the Company operates its <br />street car lines under Ordinance No. 1400 passed March 3, 1919, <br />as amended by Ordinance No. 2305 passed ~anuary 5, 1925, and as <br />said ordinances may be further amended or extended by mutual <br />agreement between the City and the Company, to maintain and oper~ <br />motor coach lines for the carriage of passengers for hire upon t~ <br />following routes: <br /> <br />The Rocky River Drive - Warren Road route: Around the loop <br />in Lakewood Park in front of the Lakewood City Hall, thence <br />southerly upon the Park drive and Belle Avenue to Clifton <br />Boulevard, westerly upon Clifton Boulevard to Warren Road, <br />southerly upon Warren Road and Alger Avenue to the boundary <br />of the City, and thence into the City of Cleveland upon sue <br />route as is agreeable from time to time to the Company and t~ <br />0ity of Cleveland, and return over the same route in reverse <br />directions in the City of Lakewood zo the Laker,cod City Hall, <br />and to cross all streets intersecting said route in the ~ity, <br />provided, however, that between gune 1st and September 15th <br />of each year the northerly terminus of said route shall be <br />at the entrance to said Lakewood Park. <br /> <br />The West ll?th Street route; From the intersection of Lake <br />Avenue and West ll?th Street thence southerly upon ¥~st-llTt~ <br />Street to the boundary of the 0ity, and thence into th~Cit~ <br />of Cleveland upon such woute as is agreeable from time b~tin <br />to the Company and the ~ity of Cleveland, and return in the <br />City of ~leveland over West llTth Street (the boundary line <br />between the City of Lakewood and the City of Cleveland being <br />in the center of West llTth Street) to Clifton Boulevard, th~ <br />easterly~upon Clifton Boulevard, northerly on ~fest llOth Stre <br />and westerly upon Lake Avenue in the City of Cleveland to the <br />place of beginning, and to cross'all streets intersecting sai <br />route in the City. <br /> <br />Said routes in the City of Lakewood shall each be subject to such <br />changes as may be mutually agreeable to the City and the Company, <br />and in the event of any temporary obstruction of either of said <br />routes, the detour to be used shall be such as is mutually agrees <br />to the Company and to the ~ayor of the City. <br /> <br /> <br />
