ORDINANCE No.3798 BY ~.,r. Lajcak AN EI~SERGENCY ORDINANCE authorizing the Director of Finance to PaY to ~ir. Howard J. Oster, 1~81 i~,iarlowe Avenue, Lakewood, Ohio, the s~a of Three Dollars and Seventy Five Cents (i~$.Vb) in full settle~ent of his claim against the city of Lakewood for damages to hisautomobzle' caused by reason of his automobile sinking into the newly filled sewer trench in front of his driveway on November 18th 1938. ~YHE_~S, at.. a meeting of Council January 3rd 1939, ~ctmon was taken to allow ~'~r. Howard J. Oster, Three Dollars and Seventy- ~ive Cents(~3.75) for this claim; and V~TEREAS, an emergency exists to provide for the usual daily operation of a municipal department arising out of the necessity of settling said claim promptly; now THEREFOP~, BE IT 0~iDA!h~ED BY THE COUNCIL 0F ~HE CITY OF L~J~E~00D, STAT~ OF 0HI0, two-thirds of all men~ers thereof concurring: Section 1. That the Director of Finance be and he is ~ereby authorized to pay to ~r. Howard J. Oster, 1281 l~arlowe Avenue ~kewood, Ohio, the s~ of Thz~ee Dollars and Seventy-Five Cents ($3.~b) full settlement of his claim against the City of Lakewood for damages to his automobile caused by reason of his auto~obile ~inkmng~ ' into the newly filled sewer trench in front of his driveway on November 18th 19~8, upon receipt of satisfactory release signed by said Howard J. Oster, releasing the City of Lakewood from any and all further liabilities in connection therewith. Section 2. That the amount set forth in Section I here- of be paid fro~ the ~en~ral Fund 1-~ (Damages paid by City). Section 3. As stated in the preamble this ordinance is declared to be an emergency measure and shall be in full force and effect upon its passage and approval by the ~ayor.
