0EDINANCE No. 3835 by Hr. Vickery AN EMERGENCY ORDINANCE authorizing the submission to a vote of the qualified electors of the City of LakewS~d of an amendment to the Charter of the City of L~ewood providing for a limitation upon taxes levied without a vote of the people and providing for the levying of taxes outside said limitation upon approval by the majority of the electors at a November election. WHEREAS, an emergency exists for the immediate preservation of the public peace, property, health and safety and to provide for the usual daily operation of the several municipal departments in that in order to secure sufficient funds required for city purposes it is deemed necessary to submit a proposed charter amendment to the electors at the next regular municipal election in the manner and within the time provided by the Constitution of the State of Ohio, now therefore BE IT ORDAINED BY THE COUNCIL OF THE CItY OF LAE~WOOD, OHIO: SECTION 1. That there be submitted to the electors of the City of ~akewood at the regular municipal election to be held Tuesday, N~ember 7, 1939, the following proposed amendment to Section 29 of Article XV of the Charter of th~ City of Lakewood: That Section 29 of Article XV of the Charter of the City of L&ewood now reading: "Section 29. ~The Council shall le~y taxes within the limitations provided by law for the purpose of paying the expense of constructing improvements and exercising the powers of the city." be and it is hereby amended to read as follows: Section 29-1: Lir~tation on Hate of Taxation. The Council shall annually levy a tax for current operatingexpenses 5~ ' the real and personal property in the City for the purposes of the City of Lakewood, its boards, departments and institution The rate of such-tax shall not exceed~slx (6) mills on the dolla of assessed valuations. ~ ~ ~ Section 29-2: Levy Outside Limitation. ~e C~u~cil shall annually levy outsid~ of the limitation provided in Section 29-1 of this Charter a sufficient sum to pay the interest, sinking fund and retirement charges on all bonds and notes of the City of Lakewood, lawfully issued, and the expenses incid to the management of the slnl~ng fund, which entire levy shall be placed before and in ~reference to all other levies. Amount certified under the laws of the State as necessary for such purposes shall not be subject to;change by the Oounc~l. Section 29-3: Additional Levies Outside Limitation. The Council shall also have the power to annually levy outside of the li~mitat~on provided in Section 29-1 of this Charter, the amount determined by Council to be necessary for the firemen's pension fund and the police pensionc fund within the limitations prescribed by the laws of the State of Ohio, a sufficient mmount to cover deductions by the county auditor from tax receipts for election expense, the annual premiums for workmen's compensation to the Industrial Commission of Ohio, expenses and services rendered by the State of Ohio and other expenses of the general fund prepaid by the county, an amount sufficient to cover the city's p~ticipation under the Municipal E~ployee's Retirement Act, and all charges or assessments made against the City by or pursuant to the Conservancy Act of Ohio. Section 29-4: Additional ~evies. On or before the 15th day of September in any year, the Council may by a resolution adopte. by a vote of two-thirds of all the members elected thereto, declare that the amount of money that may be raised by taxation
