0EDINANCE No. 3835 by Hr. Vickery <br /> <br /> AN EMERGENCY ORDINANCE authorizing the submission to a vote <br />of the qualified electors of the City of LakewS~d of an amendment <br />to the Charter of the City of L~ewood providing for a limitation <br />upon taxes levied without a vote of the people and providing for the <br />levying of taxes outside said limitation upon approval by the <br />majority of the electors at a November election. <br /> <br /> WHEREAS, an emergency exists for the immediate preservation of <br />the public peace, property, health and safety and to provide for the <br />usual daily operation of the several municipal departments in that in <br />order to secure sufficient funds required for city purposes it is <br />deemed necessary to submit a proposed charter amendment to the electors <br />at the next regular municipal election in the manner and within the <br />time provided by the Constitution of the State of Ohio, now therefore <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CItY OF LAE~WOOD, OHIO: <br /> <br />SECTION 1. That there be submitted to the electors of the City of <br />~akewood at the regular municipal election to be held Tuesday, N~ember <br />7, 1939, the following proposed amendment to Section 29 of Article <br />XV of the Charter of th~ City of Lakewood: <br /> <br />That Section 29 of Article XV of the Charter of the City of L&ewood <br />now reading: <br /> <br /> "Section 29. ~The Council shall le~y taxes within the <br /> limitations provided by law for the purpose of paying <br /> the expense of constructing improvements and exercising <br /> the powers of the city." <br /> <br />be and it is hereby amended to read as follows: <br /> <br />Section 29-1: Lir~tation on Hate of Taxation. The Council <br />shall annually levy a tax for current operatingexpenses 5~ ' <br />the real and personal property in the City for the purposes <br />of the City of Lakewood, its boards, departments and institution <br />The rate of such-tax shall not exceed~slx (6) mills on the dolla <br />of assessed valuations. ~ ~ ~ <br /> <br />Section 29-2: Levy Outside Limitation. ~e C~u~cil shall <br />annually levy outsid~ of the limitation provided in Section <br />29-1 of this Charter a sufficient sum to pay the interest, <br />sinking fund and retirement charges on all bonds and notes <br />of the City of Lakewood, lawfully issued, and the expenses incid <br />to the management of the slnl~ng fund, which entire levy shall <br />be placed before and in ~reference to all other levies. Amount <br />certified under the laws of the State as necessary for such <br />purposes shall not be subject to;change by the Oounc~l. <br /> <br />Section 29-3: Additional Levies Outside Limitation. The <br />Council shall also have the power to annually levy outside of <br />the li~mitat~on provided in Section 29-1 of this Charter, the <br />amount determined by Council to be necessary for the firemen's <br />pension fund and the police pensionc fund within the limitations <br />prescribed by the laws of the State of Ohio, a sufficient mmount <br />to cover deductions by the county auditor from tax receipts for <br />election expense, the annual premiums for workmen's compensation <br />to the Industrial Commission of Ohio, expenses and services <br />rendered by the State of Ohio and other expenses of the general <br />fund prepaid by the county, an amount sufficient to cover the <br />city's p~ticipation under the Municipal E~ployee's Retirement <br />Act, and all charges or assessments made against the City by or <br />pursuant to the Conservancy Act of Ohio. <br /> <br />Section 29-4: Additional ~evies. On or before the 15th day <br />of September in any year, the Council may by a resolution adopte. <br />by a vote of two-thirds of all the members elected thereto, <br />declare that the amount of money that may be raised by taxation <br /> <br /> <br />
