x <br /> ~ <br /> ORDINANCE N0. 3902 By Mr. Fairgrieve <br /> AN EiJ~+RGENCY ORDINANCE providing for the regulation and impound• <br /> ing of do gs running at large or disturbing the peace and quietued in <br /> the City of Lakewood, and repealing Ordinance No. 3213, adopted <br /> July 6, 1931, entitled, "An ordinance to regulate dogs owned or harbored <br /> by persons living in Lakewood and making provisions £or the impounding <br /> of such anima is and indicating the procedure when persons are bitten by <br /> such animals", and repealing Ordinance No. 1939 adopted November 6, 1922, <br /> entitled "fin Ordinance relating to dogs which have become a nuisance and <br /> regulating same", and repealing all other ordinances or parts of ordnane~ <br /> inconsistent herewit h. <br /> Vt1iEREAS, in order to provide for the immediate preservation of <br /> the public safety, property, health and welfare, and the usual daily <br /> operation of a municipal departmen, anu emergency has arisen for =C^ <br /> ' ~ the reason that immediate regulation of doffs, running at large are <br /> disturbing. the peace, is necessary, now, therefore, <br /> BE IT ORDAIhTED BY THE COUNCIL OF THE CITY OF LAKEV4'OOD, STATE <br /> OF Offi0: <br /> SECTION 1; No unmuzzled dog shall be permitted at any time t o <br /> be on a public highway, public street, public park or in a public <br /> <br /> - building or other public place or upon the land or premises of <br /> anyone other than the owner or harborer of such dog, except when <br /> • held securely in leash by the owner thereof or other responsible <br /> person. , <br /> SECTION 2: Vdhoever owning, keeping, or harboring a dog permits it <br /> to run at large or to enter any public highway, public street, <br /> public park, public building or upon the land or premises of any <br /> one other than the owner or harborer of such dog in violation of <br /> section 1, shall be guilty of a misdemeanor and upon conviction <br /> thereof shall be fined not less than p5.00~nor more than :200.00, <br /> or imprisoned Por not more than 60 days, or both, and shall stand <br /> committed until such fine is paid or sentence served or until <br /> otherwise discharged by due process of law. Each day of such <br /> violation shall constitute a separate offense. ` <br /> SECTION 3: It shall be the duty of the police o Pficers oP the <br /> C ty of Lakewood, when any unmuzzled dog is found at large in the <br /> public highway, publio street, public building or other place in <br /> violation of Section 1 to take up and impound such dog in a city <br /> pound or veterinary hospit~: No dog shall be released from pound <br /> until the cost of taking up, impounding and keeping said dog is <br /> paid to the City or Veterinarian in charge thereof, in an amount <br /> fixed by or under the authority of the Director of Public Safety, <br /> <br /> t which in no event shall be 1 ess than X2.00. t'ny dog unredeemed <br /> after ten days from the time of being taken up and impounded may,. <br /> <br /> ` be destroyed or otherwise disposed of upon order of the Director <br /> of Riblie Safety; but iP the dog has a license number an effort <br /> shall be made to locate the owner immediately upon taking up of <br /> <br /> - such dog.- The payment oP charges for redeeming a dog from the <br /> pound shall not be construed to exempt the owner of such dog from <br /> prosecution under the provisions of erections 1 and 2 hereof. <br /> SECTION 4: RABIES: Any person, firm or corporation owning or <br /> having possession or charge of any animal known to have or sus- <br /> pected of having rabies or any animal subject to rabies and known <br /> to have bitten a human being shall immediately surrender said <br /> animal to the health officer, or any police officer of the City <br /> of Lakewood upon demand of such health officer or police officer. <br /> SECTION 5: No person being the owner, keep er, or harborer of a <br /> dog shall permit such dog to disturb the peace and quietude of <br /> <br />
