Spalding <br /> AN EMERGENCY ORDINANCE to authorize. the Mayor, as Director of <br /> Public Safety to enter into a contract with the City of Cleveland for <br /> radio call service. <br /> WHEREAS, 1t is necessary to provide for the immediate preservation <br /> of the public safety and property by arranging with the City of Clevela <br /> for radio call service with reference to the Police Department, <br /> THEREFORE, BE IT ORDAINED BY THE COUNCIL OF TH'r; CITY OF LAKElN00D, <br /> S?'ATE OF OHIO s <br /> Section 1. That the j"'ayor, as Director of Public Safety, be <br /> and he is hereby authorized to enter into an agreement with <br /> the City of Cleveland for radio calls in the following forms <br /> CONTRACT FOR POI ICE RADIO CALL SERVICE <br /> TF.IS AGREEMENT, made this day of , 1942, <br /> between the CITY OF CLEVELA <br /> D~ <br /> , ~y its Direc oT o ub c afety, <br /> pursuant to the provisions of R solution No, of its Board of Control <br /> <br /> - adopted on the day of ~ , 1942, party of the firs <br /> part, and the CIT OF LAKEViiO D, y is rector of Public Safety, its <br /> duly authorized officer in the premixes, party of the second part, <br /> WITNESSETHs <br /> WHEREAS, the party of the first part owns and opera tea radio stations <br /> by means of which calls to police cruisers and information to public - <br /> officers and departments are broadcoast; and, <br /> ~i9EREAS, the party of the second part desires to use and pay for such <br /> services; and, <br /> VYREREA~' such use by the party of the second part will be beneficial <br /> to both parties; <br /> NOW, THEREFORE, said party of the first part agrees to extend the <br /> facilities of said radio stations and their service to said party of <br /> the second part for a period oi' one year beginning January 1, 1942, and <br /> ending December 31, 1942, by broadcasting calls to cruising motor <br /> vehicles of the Safety Department of said party of the second part <br /> w'renever so requested by said party of the second part, and at a cost <br /> to the latter of twenty-five cents (251) per call; and in consideratio <br /> of the party of the first parts broadcasting of such calls when and ea <br /> requested by said party of the second part, the latter party hereby <br /> agrees to pay said party of the first part therefor at the rate of <br /> twenty-five cents (251) per call, payable monthly upon receipt of the <br /> billing therefor. <br /> CONDITIONAL OPTION AS TO RADIO TRANSMISSION <br /> In the event that the party of the second part desires to have its <br /> police care and fire cars operated as a part of the uniform system of <br /> Greater Cleveland, then, iil that event, second party further agrees the <br /> the radio transmitters which it may desire to install in any such <br /> police car or fire car shall be first approved by the party of the firs- <br /> part and the installation thereof similarly approved; and thereafter <br /> such car shall be operated under the jurisdiction and control and upon <br /> the authority of such party of the first part during the period of this <br /> contract. It is further agreed by the party of the second part the t <br /> in the event it installs such radio transmitters in its police or its <br /> fire ears, then said second party shall ind~amnify and save harmless the <br /> party of the first part from any and all suits or expehsea for infringe <br /> ments of royalties or patents which may be involved in the use, install: <br /> ti on, operation or otherwise of such radio transmitters or other equip- <br /> ment authorized as provided herein. <br /> <br />
