Mary Gedeon for damages suffered. on account of the stoppage in, and expenses incurred in the repair of, the storm and sanitary sewer rwuLi.ng to or from the premises located at 1537 Minton Avenue in the City of Lakewood. ~8'f~REAS, a stoppage occured in the sanitary and storm sewer running _ to or from the main sewer in the street from the premises located at 1537 Yfinton Avenue necessitating the reconstruction and repair of said sevrer, a portion of which reconstruction and repair having been made within the street, and WHEREAS, this ordinance constitutes an emergency in that the payment of that part of said claim representing the cost of the repair of the sewer - within the street has heretofore been informally approved by this Council, and r. in that it authorizes the immediate settlement of such claim, and provides for r the usual daily operation of a municipal department, now, therefore, - BE IT ORDAINED BY THE OOUNCIL OF THE CITY OF LAKE9VOGD, STATE OF OHIO: Section 1. That settlement od' the claim of Mrs. Mary Gedeon on account of damages and expenses. incurred in the repair of the storm and sanitary sewer at 1537 Y~inton Avenue in the City of Lakewood in the total amount o£ One Hundred Sixty-nine Dollars and Thirty Cents (169.30) is hereby authorized, conditioned upon the execution and d;livery by Mrs. Mary Gedeon, widow, of a full release in favor of the City of Lakewood duly approved by the Director of Law. Section 2. That the Director of Finance be, and he is hereby, authorized to pay this said sum of One Hundred Sixty-nine Dollars and Thirty Cents 0169.30) to Lars. Mary Gedeon upon the delivery to him of the foregoing release duly executed and approved, and to charge the same to the City Portion Sewer Fund. Section 3. This ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof, and, provided it receives the affirm~.tive vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
