O~DINANCE NO. 4544 by Mr, Dawson

<br /> AN ~m~.RGENCY 0~DI~ANCE directing the appropriation of the property, herein-
<br />after described, to proceed for hospital purposes.
<br /> WHEREAS, by Resolution No. 3347 this 0ouncil declared the necessity for and
<br />the intention to appropriate to public use f~r hospital purposes the property
<br />described in said resolution; and
<br />
<br /> WHEREAS, w~itten notice thereof has been given to' the owners, persons in
<br />possession thereof, and to ~l those having an interest of record in said land in
<br />accordance with law; and
<br />
<br /> ~Et~, an emergency exists in that in order to proveed with the hospital
<br />improv~nent for which voted bonds have been issued, it is necessary to acquire said
<br />property at the earliest possible date and in order to provide for the public health,
<br />welfare and safety and for the u~,~l daily operation of a ~,n~oipal department, now
<br />therefore,

<br />Section
<br />
<br />1 - That the following described property,
<br />
<br />Situated in the City of Lakewood, 'County of Ouyahoga,
<br />and State of Ohio and being the southerly 35 feet of
<br />Sublots Nos. 242 and'243 in the Genck Realty Companyt. s .
<br />Lakewocd Subdivision~ 'of a' part of Section No. 22,
<br />Original RoCkport Towaship, as shown by the plat recorded
<br />in Volume ~, Page 26, Cuyahoga County Map Records, and
<br />being a parcel~ of land 35 feet wide on the west side of
<br />Marlowe Avenue.

<br />Beginning at ~he southeast corner of Lot No. 2~2 aforesaid,
<br />at a point in the west line of Marlowe Avenue (60 feet wide),
<br />thence westerly along the southerly line of Lots Nos. 2 42 and
<br />243, 113.50 feet to the southwest corner of Lot No. 243;
<br />thence northerly-in the westerly line of Lot No. 2 43, 35.00
<br />feet to a point; thence easterly'parallel to the southerly
<br />line of Lots Nos. 242 and 243, 112.97 feet to a point on the
<br />west line of Marlowe Avenue; thence southerly in the west
<br />line of Marlowe Avenue, 35.00 feet to the place of beginning,

<br />be, and the same is hereby, appropriated to public use fo~ hospital purposes,
<br />including the erection of aew fire-proof hospital buildings and the improvement
<br />of existing hospital buila~ngs and for establishing esplanades, parkways, ~ rk
<br />grounds and public reservations in, around and leading to said hospital
<br />so as to protect said hospital buildings and their eavlrons and to preserve the
<br />view, appearance, light, air and usefullness of public grounds occupied by said
<br />public hospital buildings and the esplanades and parkways leading thereto.
<br /> Section 2 - It is directed that such appropriation shall proceed and that
<br />the Director of Law be, and he is hereby, authorized and directed to apply to the
<br />Court of Common Pleas df ~uyahoga County to have a Jury impaneled to m~ke
<br />and assess the compensations to be paid for said property.
<br /> Section 3. That the costs and expenses of Said appropriation shall be
<br /> paid out of the hospital building improvement
<br />
<br /> Section4 . This ordinance is hereby declared to be an emergency measure
<br /> for the reasons stated in the preamble hereof and, provided it receives the
<br /> affirmative vote of two-thirds of all members elected to Council, it shall take
<br /> effect and be in force ~mm~.diately upon its adoption.
