Quinn <br /> <br /> AN E~P~ENCY CRDINANCE directing the appropriation of the propert-,~, herein- <br />after described, to proceed for hospital purposes. <br /> <br /> WHER~V~S, by Resolution No. 3348 this Council declared the necessity for <br />the intention to approoriate to public use for hospital purposes, the property <br />described in said resolution; and <br /> <br /> WP~P~AS, written notice thereof has been given %0 the 9wners, persons in <br />possession thereof, and to aH-those having a~ interest of record in said land in <br />accordance withlaw; and <br /> <br /> WHEREAs, an emergency exists in that in order to proceed with the hospital <br />improvement for which voted bonds have been issued, it is necessary to acquire said <br />property at the earliest possible date and in order to provide for the public health, <br />welfare and safety and for the usual daily operation of a municipal department, now <br />there fore~ <br /> <br /> BE IT ORDAINED BYTHE COUNCIL C~' THE CITY 9FI~¥OGD, STATE OF OHIO: <br /> Section 1. That the following described ~operty~ <br /> Situated in th~ity of Lake?~od, County of Cuyahoga, and State <br /> of Ohio, and known as being Sublet No. 241, in the Genck Realty <br /> Company's Lakewood Subdivision, of a part of Section No. 22, <br /> Original Rockport Township, as shown by the plat recorded in <br /> ¥olume 35, Page 26, Cuyahoga Oounty~p Records; and being a <br /> parcel of land on the west side of~arlowe Avenue, 45 feet wide <br /> and extending west on the north line 113.50 feet and 114.18 feet <br /> on the south 1Lue, and 45-1/100 feet in the rear, be the same more ~ <br /> less, but subject to all legal high,~ys. <br /> <br />be, and the same is hereby appropriated to public use f~ hospital purposes including <br />the erection of new fire-~:roof hospital buildings and the improvement of existing <br />hos.0italhuildings and for establishing esplanades, parkways, pa~k grounds and public <br />reserwtions in, around and leading to said hospital buildings so as to protect said <br />hospital huildin~s and their environs and to preserve the view, appearance, light, <br />air, and usefulness of public grounds occupied by said public hospital buildings and <br />the esplanades and parkways leading thereto. <br /> <br /> Section 2. It is directed that~such appropriation shall proceed and that <br />the Director of Law be, and he is hereby, authorized and directed to apply to the <br />Court of Common Pleas of Cuyahoga County to have a Jury impaneled to make inquiry <br />and assess the compensations to be paid for said proper~y. <br /> <br /> S · <br /> ectmon 3. 2~at the costs and expenses ef said appropriation shall be <br />paid out of the Hospital Building Improvement Fund. <br /> <br /> Section 4. ?~at this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and, provided it receives the <br />affirmative vote of two-thirds of all members elected to Council, ~ shall take <br />effect and be in force immediately upon its~doption. <br /> <br />Adopted: Nay 3, 1948 <br />_ 7~m.
