ORDINANCE NO. 4546 by Mr. Dawson AN w~RGENGY ORDINANCE directing the appropriation of the property, herein- after described, to proceed for hospital purposes. WHEP~AS, by Resolution No. 3349 this Council declared the necessity for and the intention to appropriate to public use for hospital purposes, the property described in said resolution; and WHEREAS, ,i-ltten notice thereof has been given to the owners, persons in possession thereof, an~ to all those having an interest of record accordance with law; V~_~A~, an emergency exists in that in order to proceed with the hospital improvement for which voted bonds have been issued, it im necessary to acquire said property at the earliest possible date a~d in order to provide for the public health, welfare and safety and for the usual daily operation of a municipal depsr tment, now therefore, BE IT ORDAINED BT THE 00UNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO~ Section 1. That the following described property: Situated in the City of Lakewood~ County of ~uyahoga, and State of Ohio, a~d kn~,~ as being eubl0t No. 240, in the Genck Realty C~mpany's Lakewood ~Ubdivision, of a part of Section No. 22,~ Original Rockport TownShip, as shown by the plat recorded in Volume 3S, Page 26, Ouyahoga County. Map Records, and being a parcel of land on the west side of marlowe Ave~e~ ~.~.~ee~~ wide and extending west on the nort~ line l~'Yee~h-~E~ south line, be the same more or less, but subject t~ all Iegal highways. be, and the same is hereby appropriated to public use for hospital purposes including the erection of new fire-proof hospital buildings and the improvement of existing hospital buildings and for establis~*~g emplanades, parkways, park grounds and public reservations in, around and leading to said hospital buildings so as to protect said hospital buildings and their environs and to preserve the view, appearance, light, air, and usefulness of public grounds occupied by said public hospital buildings and the esplanades and parkways leading thereto. Section 2~ It is directed that such appropriation shall proceed and that the Director of ~aw be, and he is hereby, authorized and directed to apply to the Court of Co,on ~leas of Ouyahoga County to have a Jury impaneled to make inquiry and assess the compensations tO be paid for said property. Section 3. That the costs and expenses of said appropriation sh~]l be paid out of the Hospital .Building Improvement Fand. Section 4. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and, provided it receives the affirmabive vote of two-thirds of all members elected to Council, it s~l taEe effect and be in force ~mmediately upon its adoption.
