NcG~ <br /> <br /> AN ~m~GENOY ORDINANCE directing the appropriation of the property, here~ r~fter <br />described, to proceed for hospital purposes. <br /> <br /> WHEREAS, by Resolution No. 3350 this Council declared the necessity for and the <br />intention to appropriate to public use for hospital purposes, the property described in <br />said resolution; and <br /> <br /> WH~m.~AS, written notice thereof has been given to the owners, p~rsonS in <br />possession thereof, and to all those having an interest of record in said land in <br />accordance with law; and <br /> <br /> ~, an emergency exists in that in order to proceed with %ha hospital <br />improvement for which voted bonds have been issued, it is necessary to acquire said <br />property at the earliest possible date and in order to provide for the public health, <br />welfare and safety ~nd for the usual daily operation of a municipal department, now <br />therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAX,.~uC~, STATE OF OHIO~ <br /> <br /> Section 1. T~at the following described proper~y: <br /> <br /> Situated in the City Of Lakewood, County of Ouy~hoga, and State of <br /> Ohio, and known as being Sublot No. 238 in the Genck Realty <br /> Company's Lakewood Subdivision, of a part of Section No. 22, Original <br /> Rockport Township, as shown by the plat recorded in Volmae 3S, Page <br /> 26, Ouyahoga County Map Records, and being a parcel .of land on the <br /> west side of Marl~e Avenue, 45 feet wide and extending west on the <br /> north line 115.54 feet and 116.22 feet on the south line, and 45 feet <br /> in the rear, be the same more or less, but subject to all legal highways. <br /> <br />be, and the same is hereby appropriated to publie use for hospital purposes including the <br />erection of new fire-proof hospital buildings and the ~mprovement of existing hospital <br />buildings and for establishing esplanades, parkways, park grounds and public reservation <br />in, around and leading to said hospital buildings so as to protect said hospital <br />build~s and their environs and to preserve the view, appearance, light, air, and <br />usefulne, ss of public gro,mds occupied by said public hospital b,,~l_~-~s and the <br />esplanades and parkways leading thereto. <br /> <br /> Section 2.~ It is directed' that such appropriation shell proceed and that the <br />Director of Law be, and he is hereby~ authorized and directed to apply to the Court of <br />Common Pleas of ~uyahoga County to have a Jury impaneled to make inquiry and assess <br />compensations to be paid for said property. <br /> <br /> Section 3. That the costs and expenses of Said appropriation shall be paid ou <br />of the Hospital Building Improvement .~u~d.. <br /> Section 4. That this ordinance is hereby declared to be an emergency measure <br />for the reasons stated in the preamble hereof andy provided it receives the affirmative <br />vote of two-thirds of all members elected to Council, it sb,11 take effect and be in <br />force immediately upon its adoption. <br /> <br />Adopted, ..
