ORDINANCE No. 4548 by Mr. ~,f-~ AN E~.~GEN~ ORDINANOE ~twecting the appropriation of the property, herein- after described, to proceed for hospital purposes. WH~RF~.S, by Resolution No. 3351 this Council declared the necessity for and the intention to appropriate to public use for hospital purposes, the proper~y described in said resolutionj and ~/EEEAS, written notice thereof has been given to.the owners, persons in possession thereof, and to all those having an interest of record in said land in accordance With law~ and .. WHEREAS~ an .eme?gency exists in that in order %o proceed ~ith the hospital improvement for which voted bonds have been issued, it is necessary to acquire said property at the earliest possible date and in order to provide for the public hoaltt: welfare and safety and for the usual daily operation of a ~m~cipal department, now therefore, BE IT ORDAINED BY THE COUNOIL OF THE OiT[ OF I2J~OOD, ~TATE OF OHIO~ Section 1. That the following described ProPertY~ Situated in the Oity of Lakewood, County of Cuyahoga and State of Ohio, and known as being Sublot No. 237, in the Genck Realty Company's Lakewood Subdivision, of a part of Section No. 22, Original Rockport Township, as shown By the plat recorded in Volume 35, Page 26, Cuyahoge County Map Records, and being a parcel of land on the west side of Marlowe Avenue, 45 feet wide and extending west on the north Line 116.22 feet and 116.90 feet on the south line, and 45.01 feet in the rear, be the same more or less, ~ut subject to all legal highways. be, and the same is hereby appropriated to public use for hospital purposes insludin the erection of new fire-proof hospital buildings and the improv~an~ of existing hospital buildings ~d for establishing esplanades, p~rk~ays, park grounds and public reservations, in, around ~nd leading to said hospital buildings so as to protect said hospital buildings and their environs and to preserve the view, appeare light, air, and usefulness of public grounds occupied By said public hospital buildings and the esplanades and parkways leading thereto. Section 2. It is directed that such appropriation shall proceed and that the Director of Law be, and he is hereby~ authorized and directed to apply to the Cour~ of Common Pleas of Ouyahoga County toheve a Jury impaneled to make inquiry andasse the compensations to be paid for said property. Section 3. 'That the costs and expenses of Said appropriation sb~l be paid out of the ~ospital Building Improvement Section4. That this ordinance ic hereby declared, to be an emergency measure for the reasons stated in the preamble hereof and, provided it receives the affirma- tive vote of two-thirds of all mambers elected to Council, it shall take effect and be in force ~mediatelyupon its adoption.
