O~INANCE No. 4549 by Mr. Dawson <br /> <br /> AN ~E. RGENCY ~RDINANCE directing the appropriation of the property, <br />hereinafter described, to proceed for hospital purposes. <br /> <br /> ~REAS, by Resolution No. 3352 this Council declared the necessity for <br />and the intention to appropriate to public use for hospital purposes, the property <br />described in said resolution; and <br /> <br /> ~W~EREAS, written notice thereof Bas been g~ven to the owners, personS in <br />possession thereof, 'and to all these having an interest of record in said land in <br />accordance with .l~w; ~a~d <br /> <br /> WHEREAS, an emergency ex~ists in-that in' order"t0 proceed with the' <br />hospital improvement for which voted b~nds have bees issued,, it is necessary to <br />acquire said property at the' earliest P0~sible date and in order tb provide for <br />the public health, welfare and safety and for the usual daily operation of a <br />municipal department, ncw therefore, <br /> <br /> BE IT ~DAII~D BY THE COUNCIL OF T~E 0-'A'[ OF LARE~00~, STATE O~ OHIO.- <br /> Section 1. That the following described .property: <br /> <br /> Situated in the City Of I~kewood, County of' Ouyahoga, and <br /> state of ~mio, ~nd known as being ~ublst No; 236 in the <br /> Genck Realty 0ompanyts Lake~ood Subdivision, of a part of <br /> Section No. 22, Original Rockport Township, as shown <br /> the plat recorded in Volume 35,. Page 26, Cuyahoga County <br /> Map Records and being a parcel of !-~d on the west side of <br /> Marlowe Avenue~ 4% feet wide a~d ~ending west on the <br /> north line 116.~O feet and 117.58 feet on the south line <br /> and45 feet in the rear, be the same more or less, but <br /> subject to all legal highavays. ...... ~... .~ <br /> <br /> be, and the same is hereby appropriated to public use for hospital purposes includin~ <br /> the erection of new fire-proof hospital buildings and the improvement of existing <br /> hospital buildings and for establishing esplanades, lmrkways, pa~k grounds and publi~ <br /> reservations in, around and lead~ng to said hospital buildings so as to protect <br /> said hospital buildings and their environS and'to preserve the'view, appearance, <br /> light, air, and usefulness of public grounds occupied by said public hospital build- <br /> ~Ss and the esplanades and parkways le?ding thereto.. <br /> Section 2. It is directed tha~ such' appropriation shall proceed and <br /> that the Director of Law be, and he is hereby, authorized and directed to apply to <br /> the Court of Common Pleas of Cuyahega County to have a Jury impaneled to make <br /> inquiry and assess the compenSationS tc~ be p~id .f,r ~a£d prop~r~yo <br /> Section 3. That the costs and expenses of said appropriation shall he <br /> out of Hospital j ....... <br /> <br /> Section 4.
