ORDINANCE No. 4551 by Mr. Dawson <br /> <br /> AN ~t~.RGENOY ORDINANCE directing the appropriation of the property, here- <br />in~fter described, to proceed for hOsPital purposes, <br /> <br /> ~HEREAS, by ResOlutiOn No; 3354 this Council declared the necessity for <br />and the intention to appropriate to public use for hospital purposes, the property <br />described in said resolution;, and <br /> <br /> ' WHEREAS~ written notice thereof has been given to the owners, p~sons in <br />possession thereof, and to all those having an interest of record in said land in <br />accordanCe with law; a~d <br /> <br /> WHEREAS, an emergency exists in that in order to proceed with the hospital <br />improvement for which voted bonds have been issued, it is necessary to acquire said · <br />property at the earliest possible dat® and in order to provide for the public health, <br />welfare and safety and for the usual daily operation of a municipal department, now <br />therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CIT~ OF IAAusnOOD, STATE OF Ol~IO~ <br /> <br /> Section 1. That the following described property~ . <br /> <br /> Situated in the City of Lakewood, Oounty of CUYahoga and ~ <br /> State of Ohio, and k~own as being Sublot No. 128 in the <br /> Belle Avenue AllOtment, cfa part of Section No. 22, <br /> Original Rockport Township, as shown by the plat recorded <br /> in Volume 41, Page 23, CUyahoga County Map Records, and' <br /> being a parcel of land on the east side of'Belle Avenue, <br /> 4~ feet wide and extending east on the nor~ line 188.45 <br /> feet and 188.35 feet on the south line, and be~n~ same <br /> premises c0n~yed to Della McFadden by deed recorded in <br /> said County Record of Deeds, Volume 130, Page 316-17-18, <br /> as appears by said plat, Be the same more or less, but <br /> subject to all legal highways. <br /> <br />be, and the same is hereby aPPropriated to public use for hospital purposes including <br />the'erectiOn of now fire-prOof hospital buildings and the improveaent of exist~"_~ <br />hospital buil~s and for establishing esplanades, parkways, park grounds and public <br />reservations in, around and leading to Said hospital Buildings so as to protect said <br />hospital buildings and their environs and to preserve the view, appearance, light~ air, <br />and usefulness of public grounds occupied by said public hospital buildings and the <br />esplanades and parkways leading there%o, <br /> <br /> Section2. It is directed that'such appropriation shall proceed and <br />that the Director of raw be, and he is hereby, authorized and directed to apply to <br />the Court of Common Pleas of Cuyahoga County to have a ju~y impaneled to make inquiry <br />and assess the compe_nsatione to be paid for said property. <br /> <br /> Section 3. That the cOsts and expenses of said appropriation shell be <br />paid out of the Hospital Building Improvement Fand. <br /> <br /> Section 4.
