ORDINANOE NO. ~552 by Mr. ~-u <br /> <br /> AN EMERGEN~ ORDINANCE directing the appropriation of the property, herein- <br />after described, to proceed for hospital purposes. <br /> <br /> V~EHEAS, by Resolution No. 3355 this Council declared the necessity for and <br />the intention to appropriate %c public use for hospital purposes, the property <br />described in said resolution; and <br /> <br /> ~S, written notice thereof has been given to the o~ers, persons in <br />possession thereof,~ and to all those having an interest of record in said land in <br />accordance with law; and <br /> <br /> WHER~S, an emergency exists in that in order to proceed with the hospital <br />improvement for which voted bonds have been issued, it is necessary to acquire said <br />property at the earliest possible date and in order to provide for the public health, <br />welfare and safety and for the~ual daily operation of a municipal department, now, <br />%herefore~ <br /> <br />~E IT ORDAINED N~ THE CO~CIL OF TNE OATX OF LAKE~0OD, STATE OF OHIOt <br />Section 1. That the following described propertyt <br /> <br />Situated in the City of Lakewood, County of Ouyahoga, and State of <br />Ohio, and kno~,~ as being Sublot No. 127 in the Belle Avenue Allotment~ <br />of a part of Section No. 22, Original Rockport Township, as shown <br />by the plat recorded in Volume 41, Page 23, Ouyahoga County Map <br />Records, and being a parcel of land on the east side of Belle <br />Avenue, 45 feet wide and extending east on the north line 188.35 <br />feet and 188.24 feet on the south line and 45.O1 feet in the rear, <br />be the same more or less, but subject to all legal highways. <br /> <br />be, and the same is hereby appropriated to public use for hospital purposes includ~ <br />the erection of new ~Ire-proof hospital buildings and the improvement of existing <br />hospital bu£1dings and for establishing esplanades, parkways, park grounds and public <br />reservations in, around and leading to said hospital buildings so as to protect <br />said hospital buildings and their environs and to preserve the vie~, appearm~ce~ <br />light~ air, and usefulness of public g~-~s occupied by said public hospital <br />buildings and the esplanades and parkways leading thereto. <br /> <br /> Section 2. It is directed that such appropriation shall proceed and that <br />the Director of Law be, and he is hereby, authorized and directed to apply to the <br />Court of Common Pleas of Ouyahcgs Oounty to have a Jury impaneled to make inquiry <br />assess the compensations to be paid for said property. <br /> <br /> Section 3. That the costs and expenses of said appropriation shall be paid <br />out of the Hospital Building Improvement <br /> <br /> Section 4. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and, provided it receives the <br />affirmative 'vote of two-thirds of all members elected to Council, it shall take <br />effect and be in force ~mmediately upon its adoption. <br /> <br />Adopted, ~a~ 3~ 1948 ~m.
