O Imm E No. Mr. naw Jn AN ~RGENCY 0RDi~ANOE directing the appropriation of the property, hereinafter described, to proceed for hospital purposes. WHEREAS, by Resolution No. 3356 this Council declared the necessity for and the intention to appropriate to public use for hospital purposes, the property described in said resolution; and WHEREAS, written notice thereof has been given to the owners, persons in possession thereof, 'and to all those having an interest of record in said land in accordance with law; and WHEREAS, an emergency exists in that in order to proceed with the hospital improvement for which voted bonds have been issued, it is necessary to acquire said property at the earliest possible date and in order to provide for the public health, welfare and safety and for the us,,~l daily operation of a ~n~cipal department, now therefore, BE IT OEDAI~m;V BY TNE COU~CIL OF THE CITY OF LAEEW0(~, STATE OF OHIO: Section 1. That the following described pro~erty~ Situated in the City ,of Lakew6od, County of CuFahoga and State of Ohio, and~ known as being Sublot NO. 126 in the Belle Avenue Allotment, of a part of Section No. 22', Original Rockport 2vw,ship, as shown by the plat recorded in VolUme 41, Page 23, Cuyahoga County Map Records, and being a parcel of land on the east side of Belle Avenue, 45 feet wide and ex~ending east on the north line 188.24 feet and 188.14 feet on the souf. h line, and 45 feet in the rear, be the same more or less, but subject to all legal higHw=ys. be, and the same is hereby appropriated to public use for hospital purposes the erection of new fire-proof hospital buildings and the improvement of existing hospital buildings and for establishing esplanades, parkways, park gvaunds and public reservations in, around and lead/rig to said hospital buildings so as to protect said hospital buildings and their environs and to preserve the view, appearaace, light, air, and usefulness of public grounds occupied by sa~t public hospital buildin. and the esplanades and parkways leading thereto. Section 2. It is directed that such appropriation shall proceed and that the Director of Lawbe, and he is hereby, authorized and directed to apply to the Court of Common Pleas of Ouyahoga County to have a Jury impaneled to make inquiry and assess the comp_ensatio~s to be paid for said property. Section 3. That the costs and expenses of said appropriation shall be paid out of the Hospital Building Improvement Fand. Section 4. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble heroofand, provided it receives the affirmat~ vote of two-thirds of all members elected to Council, it shall take effect and be in force immedlatelyupon its adoption.
