ORDINANCE NO. 4557 by Mr. McG~ll <br /> <br /> AN k~RGENCY ORDINANCE authorizing the Mayor, on behalf of the City <br />of Lakewood, to purchase the certain real estate located on Marlowe Avenue in <br />the City of Lakewood hereinafter more particularly described. <br /> <br /> WHEREAS, this ordinance constitutas an emergency in that, by legislation <br />heretofore adopted, this Council has appropriated and instructed the Director of <br />Law to proceed with action to assess compensation with respect to the proper~y <br />hereinafter described which action, but for this ordinance, will be filed forthwith; <br />in that the owner has agreed to sell said property for the consid~retion hereim- <br />after stipulated which this 0ouncil deems to be in the best interests of the City; <br />and in that it provides for the public health and welfare and the usual dally <br />operation of a municipal dep~ument, now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LA~EWO00, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be, and he is hereby, authorized to purchase <br />from Meltie N. Blanchard the following described property: <br /> <br />Situated in the City of Lakewood, County of Cuyahoga, <br />and S~ate cf Ohio, and known as being Sublet No. 238 <br />in the Genck Realty Company's Lakewood subdivision, <br />of'a part of Section No. 22, Original Rockport Township, <br />as shown by the plat recorded in Volume 35, Page 26, <br />Cuymhoga County Map Records, and being a parcel of land <br />on the west side of Marlowe Avenue, 45 feet wide and <br />extending west on the north line 115.54 feet and 116.22 <br />feet on the south line, and 45 feet in the rear, be the <br />same more or less, but subject to ail legal highways. <br /> <br />and to pay therefor the sum of Thirteen Thousand Dollars ($13,000.00). <br /> <br /> ' ~ Section 2. That the title to said property s~all be subject to the <br />approval of the Director of Law; that taxes and assessments shell be pro-rated <br />as of the date of transfer; that the Director of Finance be, and he is hereby, <br />authorized tc pay the amount set forth in Section 1 hereof from the Hospital <br />Building Impr.ovement~Fand upon delivery by Meltie N. Blanchard of her Warranty <br />Deed to the Cmty of ~akewood, together with Guaranty of Title disclosing the said <br />real estate to be free and clear of all encumbrances, excepting taxes and assessmen <br />not yet due and payable, zoning' ordinances and restrictions of record, if any; and <br />that the Director of Flnance be, and he is hereby, authorized to pay the costs <br />incidental to the completion of the purchase of said real estate, including the cos <br />of recording the Deed and one-half of the escrow agent's fee from said fund. <br /> <br /> Section 3. This ordinance is hereby declared to be an emergency measux <br />for the reasons stated in the preamble hereof and, provided it receives the affirm~ <br />tive vote of two-thirds of all members elected to Council, it shall take effect an¢ <br />be in force ~mmediately upon its adoption and approval by the Mayor. <br /> <br />Adopted: May ,27~ 1948 Wm.
