RGENCY ORDINANCE authorizing the Mayor, on behalf of the <br /> City of La~wood, to purchase the certain real estate located on Marlowe Avenue <br /> in the City of Lakewood hereinafter more particularly described. <br /> <br /> WHEREAS, this ordinance constitutes an emergency in that, by legislation <br /> heretofore adopted, this Council has appropriated and instructed the Director of <br /> Law to proceed with action to assess compensation with respect to the proper~ <br /> hereinafter described which action, but for this ordinance, wfll he f~l-d forthwith.. <br /> in that the v,~er has agreed to sell said property for the consideration herein- <br /> after stipulated which this Council deems to he in the best Interests of the City; <br /> and ~h that it provides for the public health and welfare and .the usual daily <br /> operation of a municipal department, now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CIT~ OF LAEEWOOD, STATE OF OHIO: <br /> <br /> Section 1. ~hat the Mayor be, and he is hereby, authorized to purchase <br /> from Amelia Maroney the following described property: <br /> <br /> Situated in the City of Lakewood, County of <br /> Ouyahoga, and State of Ohio, and known as <br /> ' being Sublet No. 236 in the Gensk Realty <br /> ~ ~ ~ompany's Lakewood Subdivision, of a p~wt of <br /> Section No. 22, Original Rockport Township, <br /> as shuw~, by the plat recorded in Volume 35, <br /> Page 26, Cuyahoga County Map Records and being <br /> a parcel of land on the west side of Marlowe <br /> Avenue, 45 feet wid9 and ex'~ending west on the <br /> north line 116.90 feet and f~17.%8 feet on the <br /> south line and 45 feet in the rear~ he the same <br /> more or less, but subject to all legal high. ways. <br />and to pay therefor the sum of Fourteen Thousand Dolla~rs i$14,000.00). <br /> Section 2. That the title to said property shall be subject to the~ <br />approval of the Director of Law; that' taxes and assessments shell be pro-rated as <br />of the date of transfer; that the Director of Finance be, and he is hereby, <br />authorized to pay the amount set forth in Section 1 hereof from the Hospital <br />Building Improvement Fund upon delivery by Amelia. Maroney of her Warranty Deed, <br />hearing signature of Dennis F. Maroney, to the City of Lakewood, together with <br />Guaranty of Title disclosing the said real estate to be free and clear of all <br />encumbrances, excepting taxes and assessments not yet due and ~ayable, zoning <br />ordinances and restrictions of record, if any; and that the ~i~ctor of Finance <br />be, and he is hereby, authorized to pay the costs incidental'to the completion of <br />the purchase of said real estate, including the cost of recording the ~ed and <br />one-half of the escrow agent's fee ~om said fund~-~-" - <br /> <br /> Section 3.
