ORD'~NANCE NO. 4562 by Mr. Quinn AN EMERGENCY ORDINANCE AUTHORIZING ~HE MAyor, on behalf of the City of ~La.k~vood~ to purchase the certain real estate located on Narlowe Avenue in the Cmty of Lakewood hereinafter more particularly described. WHEREAS, thais ordinance constitutes an emergency in that, by legislation heretofor adopted, this Council ~as appropriated and instructed the Director of Law to proceed with action to assess compensation with respect to the property hereinafter described which action has been filed in the Court of Common Pleas of Cuyahoga County; in that settlement of this action has been reached wher~ the w:Aer has agreed, subject to retaining possession of said property rent free until August 15, 1948, to sell said property for the consideration hereinafter stipulated which this Council deems to be in the best interesms of the City; and in that it~ provides for the public health and welfare and the usual daily operation of a municipaldepar~ment, now, therefore, BE IT ORDAINED BT THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Secti~un l~ That the Mayor be, and he is hereby, authorized to purchase from Joseph . Hall the following described property: Situated in the City of Lakewood, C. ount~y of Cuyahoga, and State of Ohio, and kno,~ as being Oublot No. 241, in the Gensk Realty Company' s Lakewood Subdivision, of a part of Section No. 22, Original Rockport Township, as shown by the plat recorded in Volume 35, Page 26, ~ Cuyahoga County Map Records; and being a parcel of land on .the west side of Marlowe AvenUe, 45 feet wide and extending west on the north line 113.50 feet and 114.18 feet on the south line, and 45-1/100 feet in the rear, be the same more or less but subject to all legal highways. and to pay therefor the sum of Eleven Thousand Dollars ($11,000.00). Section 2. That the title to said property shall be subject to the approval of the Director of Law; that possession shell be givent o the City by Joseph C. ~all on or before August 15, 1948; and that taxes and assessments sh~11 be pro- rated as of the date of transfer; that the Director of Finance be, and he is hereby, authorized to pay the amount set forth in Section 1 hereof from the Hospital Building Improvement F~nd upon delivery by Joseph C. Hall of his Warranty Deed, also bearing signature of Cora Hall, to the City ef Lakewood, together with Guaranty of Title disclosing the said real estate to be free and clear of all encumbrances, excepting taxes and assessments not yet due and payable, zoning ordinances and restrictions of record, if any~ and subject to possession of said property rent free until August 15, 1948; and that the Director of Finance be, and he is hereby authorized to pay the costs incidental to ~he completion of the purchase of said real estate, including the cost of recording the Deed and one-half of the escrow agent,s fee from said fund. Section 3. This ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and, provided it receives the affirmati~ vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
