ORD'~NANCE NO. 4562 by Mr. Quinn <br /> <br /> AN EMERGENCY ORDINANCE AUTHORIZING ~HE MAyor, on behalf of the City of <br /> ~La.k~vood~ to purchase the certain real estate located on Narlowe Avenue in the <br /> Cmty of Lakewood hereinafter more particularly described. <br /> <br /> WHEREAS, thais ordinance constitutes an emergency in that, by legislation <br /> heretofor adopted, this Council ~as appropriated and instructed the Director of <br /> Law to proceed with action to assess compensation with respect to the property <br /> hereinafter described which action has been filed in the Court of Common Pleas of <br /> Cuyahoga County; in that settlement of this action has been reached wher~ the <br /> w:Aer has agreed, subject to retaining possession of said property rent free until <br /> August 15, 1948, to sell said property for the consideration hereinafter stipulated <br /> which this Council deems to be in the best interesms of the City; and in that it~ <br /> provides for the public health and welfare and the usual daily operation of a <br /> municipaldepar~ment, now, therefore, <br /> <br /> BE IT ORDAINED BT THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Secti~un l~ That the Mayor be, and he is hereby, authorized to purchase <br /> from Joseph . Hall the following described property: <br /> <br /> Situated in the City of Lakewood, C. ount~y of Cuyahoga, <br /> and State of Ohio, and kno,~ as being Oublot No. 241, <br /> in the Gensk Realty Company' s Lakewood Subdivision, of <br /> a part of Section No. 22, Original Rockport Township, as <br /> shown by the plat recorded in Volume 35, Page 26, ~ Cuyahoga <br /> County Map Records; and being a parcel of land on .the <br /> west side of Marlowe AvenUe, 45 feet wide and extending <br /> west on the north line 113.50 feet and 114.18 feet on the <br /> south line, and 45-1/100 feet in the rear, be the same more <br /> or less but subject to all legal highways. <br /> <br />and to pay therefor the sum of Eleven Thousand Dollars ($11,000.00). <br /> <br /> Section 2. That the title to said property shall be subject to the approval <br />of the Director of Law; that possession shell be givent o the City by Joseph C. <br />~all on or before August 15, 1948; and that taxes and assessments sh~11 be pro- <br />rated as of the date of transfer; that the Director of Finance be, and he is <br />hereby, authorized to pay the amount set forth in Section 1 hereof from the <br />Hospital Building Improvement F~nd upon delivery by Joseph C. Hall of his Warranty <br />Deed, also bearing signature of Cora Hall, to the City ef Lakewood, together with <br />Guaranty of Title disclosing the said real estate to be free and clear of all <br />encumbrances, excepting taxes and assessments not yet due and payable, zoning <br />ordinances and restrictions of record, if any~ and subject to possession of said <br />property rent free until August 15, 1948; and that the Director of Finance be, and <br />he is hereby authorized to pay the costs incidental to ~he completion of the purchase <br />of said real estate, including the cost of recording the Deed and one-half of the <br />escrow agent,s fee from said fund. <br /> <br /> Section 3. This ordinance is hereby declared to be an emergency measure <br />for the reasons stated in the preamble hereof and, provided it receives the affirmati~ <br />vote of two-thirds of all members elected to Council, it shall take effect and be in <br />force immediately upon its adoption and approval by the Mayor. <br /> <br />Adopted: <br /> <br />June 7~ 1948 <br /> <br />Wm.
