ORDINANCE No. 4564 by Mr. Quinn <br /> <br /> AN E~ERGENCY ORDINANCE authorizing the Mayor, on behalf of the City <br />of Lakewood, to purchase the certain real estate located on Belle Avenue in the <br />City of Lakewood hereinafter more particularly described. <br /> WHEREAS, this ordinance constitutes an emergency in that, by legislatio~ <br />heretofore adopted, this Council has appropriated and instructed the Director of <br />Law to proceed with action to assess compensation with respect to the property here- <br />inafter described which action has been filed in the Court of Common Pleas of <br />Cuyahoga County; in that settlement of said action bas been reached whereby the <br />owner has agreed, subject to retaining possession of s. aid p.r. ope~rty r. ent~_free.u, nt~_l~_ <br />September 1, 1948, to sell said property for the cc~smderemmon neremnai~er s~mpu~a~ <br />which this Council deems to be in the best interests of the City; and in that it <br />provides for the public health and welfare and the usual daily operatign of a <br />municipal department, now, therefore, <br /> BE IT ORDAINED BY THE coUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That the Mayor be, and he is hereby, authorized to purchas <br /> from Marie Schuster the following described property: <br /> Situated in the City of Lake~ood, County of Cuyahoga, <br /> and State of Ohio, and kno~ as being Sublot No. 127 <br /> in the Belle Avenue Allotment, of a part of Section <br /> No. 22, Original Rockport Township, as shown by, the <br /> ~lat recorded in Volume 41, Page 23, Cuyahoga County <br /> ~ap Records~ and being a parcel of land on the east <br /> side of Belle Avenue, 45 feet wide and extending east <br /> on the north line 188.35 feet and 188.24_feet on the <br /> south line and 45.01 feet in the rear, be the same more <br /> or less, but subject to all legal highways. <br /> and to pay therefor the sum Of seventeen Thousand Five Hundred Dollars ($17,500.00) <br /> Section 2. That the title to said property shall be subject to the <br /> approval of the Director of Law; that possession shall be given t o the City by <br /> the owner September 1, 1948; that taxes and assessments shall be pro-rated as of <br /> the date of transfer; that the Director of Finance be, and h~ is hereby authorize <br /> to pay the ~mount set forth in Section 1 hereof from the Hospital Building Im!iove~ <br /> Fund upon delivery by Ma~rie Sch~u~t~.er of.he~o~aerntwY t~e~br~an~fsTi~t~teU~i <br /> Rudolf Schuster, to the ~ity o~ a~ewoo~, g i s os~ <br /> the said real estate to be free and clear of all encumbrances, excepting taxes and <br /> assessments not yet due and payable, zoning ordinances and restrictions of record, <br /> if any, and subject to possession of said property rent free until September 1, 191 <br /> and that the Director of Finance be, and he is hereby, authorized to pay the costs <br /> incidental to the completion of the purchase of said real estate, including the <br /> cost of recording the Deed and one-half of the e~crow agent's fee f~om said fund. <br /> ~ection 3. This ordinance is hereby declared to be an emergency mess <br /> for the ~reasons stated in the preamble hereof and, provided it receives the affirm <br /> vote of two-thirds of all members elected to Council, it shall take effect and be <br /> in force immediately upon its adoption and approval by the ~yor. <br /> ~m.
