~RDINANCE NO. 4568 EYNr. McGiI1 <br /> <br /> AN ORDINANCE to regulate and fix the prices and terms upon which <br />the East Ohio Gas ComPany, its successors and assigns, shall be required <br />to furnish natural ga~ to the city of Lakewood, Ohio and its inhabitants. <br /> <br /> WHEREAS, The East Ohio Gas Company is the lawful successor to the <br />original The East OhioGas Company to which was granted the right to <br />enter upon the streets, alleys and public grounds of the City of Lakewood <br />for laying and maintaining gas mains, pipes and other appliances for <br />the purpose of supplying natural gas to the Oity of Lakewood and its <br />inhabitants as recited in OrdinanCe No. ~i1, adopted December 2, 19075 <br />and <br /> <br /> ~HE~EA$, this Council desires to enter intO a contract regulating <br />and fixing the prices andterms upon which The East Ohio Gas ComPany <br />shall furnish natural gas, now, therefore, <br /> <br /> BE IT. ORDAINED BY TNE COUNCIL OFT~E CITY OF LAXEWOOD, STATE OF <br /> <br /> Section 1. ~herever in this ordinance the term "the Company" is <br />used it shall be understood and intended to mean The East Ohio Gas Company~ <br />and wherever the term "city"is used, it shall be understood and intended <br />to mean the City of LakewoOd, Ohio, a municipaI corporation. <br /> <br /> Section 2. The service lines from the mains and pipes of the <br />Company to the curb and curb box shall Be installed and maintained at <br />the expense of the Company. and the Company shall, at its own cost and <br />expense, supPly and maintain all meters and regulators and they shall be <br />of standard make. <br /> <br /> Section 3. The Company shall extend its pipes and mains for the <br />furnishing of natural gas to and upon any dedic~2ed street__avenue, high- <br />way, alley, public ground or any part thereof within the limits of said <br />City wheneve~ at.least one (1) cons_umer on an average fo~ cap} ad~}tional <br />one hundred (100} feet of pipe in the street or streets xn wnxch ~ne <br />extension is to be run, shall first in writing agree to take a supply of <br />natural gas at the then established rate, measurement to betaken from <br />the end of the nearest low pressure line~ provided, h~weyer,,}hat <br />Company shall not be required to make any extensions durzng ~ne mon~ns <br />of December, January, February and March of any year. <br /> <br /> Section $. The term ,natural gas" as used herein is intended to <br />mean natural gas of the quality and character produced by nature in the <br />petroleum, oil and natural gas fieldS of West Virginia and Ohio, or <br />elsewhere, which natural gas is to b? furnished in its natural state <br />without mixture of air, the abstr~ctmon of-any natural elements or adul- <br />teration, at the consumer's meter, subject, however, to_the r~mov~ o~ <br />oil and gasoline vaporsl provided, h?wever, t~t natur~l_~as.xurnx~nea <br />or delivered pursuanp to t~e t~r~s_o~ }his.~raxn~ncet~naix a~w~s <br />a heat value of not less than ¥~ ~ritlsh ~nermai un-ts per cuoxc ~oo~ <br />at 15.6 pounds per square inch absolute pressure ($ ounces per square <br />inch above atmospheric pressure at 15.3~ pounds per ~quare inch) 60 <br />degrees temperature Fahrenheit (~20 degrees absolute) and .6 specific <br />gravity. Tests to determine the British thermal units may be made from <br />time to time in the city limits by said City through representatives <br />duly authorized by council. <br /> Section 5. PREFERENCES. If at any time during the term of this <br /> ordinance the Company is unable to obtain a full supply of natural gas, <br /> the amount which the Company does obtain shall be fairly apportioned <br /> among the municipalities which the 0ompany is under obligation to supply. <br /> <br /> <br />
