ORDIN~E NO. 4659 BY Mr. Quinn AN EIS~IGkNCY ORDINANCE authorizing settlement of the claim of Ethel Stine for personal injuries and expenses alleged to have been sustained on January 6, 1948 by reason of falling on a sidewalk in the City of Lakewood at or near 12221 Clifton Boulevard° ~YHERE~2, Ethel Stine has filed suit against the City of Lakewood in an action entitled "Ethel Stine vs. City of Lakewocd'~Court of.~ommon Pleas No. 590467 praying JUdgment in the amount of $6500.00 for personal injuries sustained by reason of falling on a sidewalk; and WHEREAS, this ordinance constitutes an emergency in that, in order to save the ~ity from further litigation and pessible additional expense,it authorizes t~he immediate settle~ent of such claim and provides for the usual daily operation c~ a municipal department~ now, therefore, BE IT ORDAINED BY THE EOUNCIL OF THE ~ITY OF IAK~YOOD, STATE OF Section 1. That settlement of the claim and action of Ethel Stine for the sum of $100.00 is hereby authorized conditioned upon execution and delivery by her of a full release in favor of the .Eity of Lakewood duly anproved by the Director of Section 2. That the Director of Finance be, aDJ he is hereby, authorized to Pay the sum of $100.00 to Ethel Stine upon delivery to him of the foregoing release dUly executed and approved and to charge the same to the General Fund . Damages Paid by the ~ity. Section 3. This ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and, provided it receives the affirmative vote of two-thirds of all m~abers elected to Oouncil, it shall take effect and be in force immediately upon its adoption and approval by the ~yor.
