ORDINANCE NO. 4714 BY Mr. Quinn AN EMERGENCY ORDINANCE authorizing the Mayor to enter into an agreement with Duncan Parking Meter Corporation, for the installation, lease and purchase of parking meters in the City of Lakew~od. WHEREAS, this ordinance constitutes an emergency, in that after advertise- meat and receipt of bids, this Council awarded the contract to Duncan Parking Meter Corporation for installation of Miller Manual Parking Meters, thus requiring the prep- aration cf, and further action by this Council with respect to an agreement; and in that it provides for the public safety and welfare and the msual daily operation of a municipal department, mow therefore~ ~R. IT ORDAINED BT THE ~0UNOIL OF THE CITI OF LAKEWOOD, STATE OF OHIO~ Section 1, That the Mayor Be, and he is hereby, authorized to enter into an agreement with Duncan Parking Meter Corperat~ion~ which agreement~ hereby approvedj shall read substantially as foll_~wss TPJAL lEASE AGreemeNT This agreement, executed in quadruplicate this 12th da~ of December 19~0, Between the City of LakeWOed~ of the State of Ohio (hereinafter called the "Citye)j · and Duncan Parking Meter Corporation, an I~ nois corporation (hereinafter called the "Company,); FiTNESSETH~ That: THE COMPAFf AGREES~ LEASE 1. To lease to the City not less than 200 nor more than 225, Miller Manual parking meters (hereinafter called "meters'), at an agreed value of Si~ty-four Dollars ($64.00) per meter, ten penny, two nickel, eno ~fme, two hour accumulative t~pe. DISCOUNT 2e That if the agreed value shall be paid within sixt~ (60) days from date of installation, the City may have a discount ef two per cent (2%)e T~E REG. 3. TO furnish the meters with a mechanism regulated as to time and equipped with slots for coins as may Be determined by the City~ ~Ithi~,~the practicable ~fm~ts of the meters currently produced by the Company. EXTRAS 4. To furnish without additional charge one (1) complete meter mechanism for service purposes on/~, for eanh fifty (~0) meters installed under this agreement, INSTALLATION COST ~e To pay all costs in connection with the delivery, installation and installation supervision ~f the meters and at tim~ of installation to give in- struction te the City appointed maintenance ma-_ as to their maintenance. To replace any defective part, on the return thereof to the factory within one (1) year from date of installation of that matere TRIAL PERIOD 7, To permit the City to terminate this lease after a trial period of twelve months (12) of actual operation of the meters upon written notice gi~'en by the City to the Company at 83~ North Wood Street, Chicago 22, Illinois, or at such other address as may hereafter Be designated in writing by the Ccmpany, during the thirty (30) day period following the expiration of said trial period. The Company, will, after receipt of such notice, at its own expense, remove the meters and repair any damage caused by such removal. T~m~ is of the essence of the provisions of this paragraph, OPTION 8. That the City may lease additional meters for its use, at the same agreed value and terms, except the terms of paragraph seven (?), or at a lower agreed value if in effect at that time. The City may exercise this privilege from time to time until the agreed value of the meters described in paragraph one (1) has been paid~
