<br /> An emergency ~A~inanoe ~egu!atlng hours of labor~ holidays,
<br />Vacations and working conditions of members of the Division of Fire,
<br />Department of Public Safety.
<br />
<br /> .Whereas, an emergency exicts in that it is immediately nec-
<br />essary to provide for hours of labor~ holidays, vacations and work-
<br />lng conditions for members of the division of Fl~e, Department of
<br />Public Safety, comparable to those provided for employees in other
<br />Divisions and Departments, and to provide fo~ the usual daily Opera-
<br />tion of a department, and
<br />
<br /> Whereas, the Statutes of the State of Ohio now provide (a) for
<br />the operation of fl~e departments under the two-platoon system, such
<br />as now exists in the City of ~.akewood, (b) that, except in event of
<br />extraordina~y emergency, the work week for members of fire departments
<br />shall not exceed seventy-two (?2)~hoxtvs in any Oalendar week, and (t:)
<br />that such members shall have & ~aeation of at'least two (2) weeks
<br />each calendar yea~,, now, therefore

<br /> BE XT ORDAINED BY THE OOU~OIr. OF ~E CITY OF LAK~OOD~ S?ATE
<br />OF OHIO:
<br />
<br /> SeCtion 1.. Except as hereinafter p~Ovided, the customary and
<br />avera~e'"wor~ week Of members of the Division Of Fire, Department of
<br />Public Safety, shaXX be seventy-two [?~) hours pe~ calendar week, and
<br />such members shall have vacations of two weeks per calendar year.

<br /> Section 2. Members-Of the Division of Fire, Department of
<br />Public ~a~e~y, ~n addition to such vacation, shall be granted as holi-
<br />days~ New Yea~s Day, Memorial Da y,.Xndependence Day, ~sbo~ Day,
<br />Thanksgiving Day and Christmas Day, Members may be required to work
<br />on the foregoing named holidays~ provided, however, that in the event
<br />any member is ~equi~ed to work on any such holiday such member shall
<br />be granted a day off, in lieu cf such holiday. ~n the event any mem.
<br />bar ia off duty on any such holiday, fop any reason other than
<br />absence on sick leave, Or unexcused absence, such member shall be
<br />g~eated a day off, in lieu Of such holiday. In all cases, the dates
<br />Of days off dutybecause of or in Xieu of holidays shall be designmted
<br />by the Chief of the DivisiOn of Fi~e and shall be designated so as
<br />to cause minimum interference with the sustoma~y and normal operation
<br />of the Division.
<br />
<br /> Section ~.. Xn application of this ordinance~ the term #day
<br />off" shoal be construed to equal twelve (12) hours off duty, of hours
<br />normally scheduled for duty under the two-platoon system, and the
<br />grant Of six (6) holidaFs per calendar yea~ shall be construed to
<br />equal ~eventy-two (72) hours off such duty pe~ calendar year.
<br />
<br /> Section 4. Nothing heretnabove set forth shall be construed
<br /> 1' ~0 '~'
<br /> ! ~ aero~a~e from any power which may exist to enforce departz~ental
<br />discipline by depriving any membe~ of theDivision of Fire of holidays
<br />c~ of days off duty, or (2)to authorize payment of additional or
<br />premium compensation for work performed on a holidays
<br />
<br /> Section 5. ~n the event tha~ the ~ief of the Division of
<br />Fire, Department of Public ~afeYy, determines that an extraordinary
<br />emergency exists, which requi~es additional hours of service by
<br />of said Division of Fire, he shall report such determination and
<br />his recommendation to the ~ayo~. Y~u such event, and to the extent
<br />5he Mayor ¢oncu~, the Mayor is hereby authorized and empowered to es
<br />find and declare and to thereupon require members'of the Division of
<br />Fi~e to work on any of the above stated holidays without sllo~mnce of
<br />time off in lieu thereof. Any such action shall become effective
<br />Upon the posting on the bulletin board in the headquarters of the
<br />Division of Fi~e of a notice signed by the Mayor, and shall continue
<br />until ~otlce of termination is similarly posted. ~n case of an~ such
<br />action, the Mayor shall fully report the fact thereof and the reasons
<br />therefo~ to Council at its next ~egula~ meeting.
