Page #2 <br /> <br />contains various types of vegetable growth and other deoosit which exudes unpleasant <br />and obnoxious odors; that it is located on ground highe~ than surrounding property <br />without provision for adequate and proper drainage; that it is located clOSe to <br />Lakewood Hospital; that it is generally uncapped for including non-payment of taxes; <br />that it is unsanitary; that all such conditions are contrary to the public hea!t.b, <br />comfort~ welfare and Safety of the citizens of the City of Lakswood and said Wager <br />Cemetery is hereby declared to be a nuisance and the continuance thereof is hereby <br />prohibited, <br /> <br /> Section 2. Thet the o%~aers of the said property shall cause said nuisance to <br />be abated by (1) removing all noxious growths and deposits therefrom and (2) the dis- <br />~nterment ~ud removal therefrom of all bodies b~mied therein, all within 30 days from <br />the date this ordinance takes effect. <br /> <br /> Section 3~ The Owmers of Wagar Cemetery or any ether individual responsible <br />for the conditions therein or pertaining thereto, who fail to eliminate said condi- <br />tions within said cemetery in the manner andwithin the time specified in Section 2 <br />hereof, shall be ~ilty of a misdemeanor and upon conviction thereof shall be fined <br />in any sum which together with the costs of prosecution does not exceed fifty dollars <br />($50.00); provided further, that each day~!s violation shall be considered a separate <br />and distinct offense. <br /> <br /> Section 4.
