Nichols s~nd Progressive ~Jutual Insurance Eompany in <br />the total amount of Seventy-five Dollars and Eighty Gents ($75.80), arising from <br />a collision between a City truck and an automobile operated by Robert G. Nichols. <br /> <br /> ~¢n~.w.d.~, the automobile belonging to H. & N. Par-Pak Co~-~oany and/or Robert <br />G. Nichols, was damaged on or about February l, 1951 as a result of a collision <br />v¢ith a ~ity of Lakewood tm~ck operated by its employe, Nicholas A. Jakwerth, such <br />collision occurring at or near the intersection of Highland Avenue and Franklin <br />Boulevard in the ~ity of La,wood; and <br /> <br /> ~UqEHEAS, t~his ordinance constitutes an emergency in that settlement m~v be <br /> made on the foregoing basis forthwit_h~.,in that said claim has heretofore been in- <br /> formally approved by EOUncil; and in that this Ordinance provides for the usual <br /> daily operation of a municipal department, now, therefore, <br /> <br /> BE IT 0PJJ~L~,~ED BY T_W~ ~OUNCIL OF TB~ CITY ~ LAK~OOD, STATE OF 0I~0: <br /> <br /> Section 1. That the Direct ' · <br /> ..... or of Fmnauc~. be, and he ms hereby, authorized <br />and mmrec%eG %o pay the sum of Fifty Dollars ($50,00) to H. & N. Par-Pak Company <br />and the sum of Twenty-five Dollars and Eighty Sents ($25.80) to Progressive ~tual <br />~n <br /> = surance Co:~pany, together amounting to a total of Seventy-five Dollars and Eighty <br />Cents ($75.80), in full settlement of the foregoing described damages, and allother <br />claLms incident to said collision, if any, conditioned, however, upon the execution <br />and delivery by H. & N. Par-Pak Sompany, Robert G. Nichols and Progressive ~'.~tual <br />Insurance ~,ompany, of a full release in favor of the $ityof Lakewood and Nicholas A. <br />Jakwerth, duly approved by the Director of I~w; the Director of Finance to charge <br />said payment to the General Fund - Damages Paid by the Eity. <br /> <br /> Section 2.
