ORDINANCE NO. ~?73 BY Mr. Gottermeyer <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor to enter into an agreement <br />with Duncan Parking Meter Corporation modifying the agreement entered into <br />May 8, 1951, between said corporation and the City of Lakewood, all as here- <br />inafter more particularly set forth. <br /> <br /> WHEREAS, this ordinance constitutes an emergency in that the termination <br />of the City's agreement with the Detroit-Warren Betterment Association require <br />in the opinion of this Council, ~mmedia~e change, in p½ans.w~th r~spe~ to ~t~ <br />and off-street parkingi in that it carrxes out the prxor xnx-ormaA actxon, o~ <br />Council~ and in .that it provides for the public welfare and safety and the <br />usual daily operation of a municipal department~ now, therefore, ~ <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF T~E CXTY~F LAXEWOOD, STATE OF ORIOz <br /> <br /> Section 1. That the Mayor be, and he is hereby, authorized to enter int¢ <br />a~.eement with ~unean Parking Meter Corporation modifying the Agreement of <br /> , 19~1, such modifying agreement to read substantially as follows~ <br /> <br />THIS AGREEMENT executed in quadruplicate this .day of_ <br />__, 19~1, between the City of Lakewood, an Ohio <br />mun c pa: corporation hereinafter called City, and Duncan Park- <br />ing Meter Corporation, an Illinois corporation, hereinafter <br />called Company, · <br /> <br /> w_ _x s_ s_ <br /> <br /> The City and the Company hereby mutually agree that paragraph <br /> numbered 1 of their agreement providing for the leasing of park- <br /> ing meters dated May 8, 1951, shall be, and it is hereby, modified <br /> and changed to read as follows~ <br /> <br /> "1. To lease to the City Eight Hundred (800~ Miller Manua~ <br /> Multiple-coin parking meters (hereinafter called 'meters'~, <br /> at an agreed value of Sixty-four Dollars ($65.00~ per meter, <br /> (~ltiple-coin to he one penny, one nickel, one dime, two <br /> nickels and ten penny of the two hour accumulative type, <br /> excepting that 150 of said parking meters shall be one. <br /> nickel multiple-coin of the ten hour accumulative type~o~ <br /> <br /> which paragraph.l, as change~, shall he considered as part of said <br /> agreement, dated ¥~y 8, 1951, otherwise said agreement and all <br /> provisions thereof to ~emain in full force and effect. <br /> <br /> IN WITNESS WHEREOF. the parties hereto have executed this agreement <br /> the date and year ~irat above written. <br /> <br /> Section 2.
