ORDINANCE NO. ~?73 BY Mr. Gottermeyer AN EMERGENCY ORDINANCE authorizing the Mayor to enter into an agreement with Duncan Parking Meter Corporation modifying the agreement entered into May 8, 1951, between said corporation and the City of Lakewood, all as here- inafter more particularly set forth. WHEREAS, this ordinance constitutes an emergency in that the termination of the City's agreement with the Detroit-Warren Betterment Association require in the opinion of this Council, ~mmedia~e change, in p½ans.w~th r~spe~ to ~t~ and off-street parkingi in that it carrxes out the prxor xnx-ormaA actxon, o~ Council~ and in .that it provides for the public welfare and safety and the usual daily operation of a municipal department~ now, therefore, ~ BE IT ORDAINED BY THE COUNCIL OF T~E CXTY~F LAXEWOOD, STATE OF ORIOz Section 1. That the Mayor be, and he is hereby, authorized to enter int¢ a~.eement with ~unean Parking Meter Corporation modifying the Agreement of , 19~1, such modifying agreement to read substantially as follows~ THIS AGREEMENT executed in quadruplicate this .day of_ __, 19~1, between the City of Lakewood, an Ohio mun c pa: corporation hereinafter called City, and Duncan Park- ing Meter Corporation, an Illinois corporation, hereinafter called Company, · w_ _x s_ s_ The City and the Company hereby mutually agree that paragraph numbered 1 of their agreement providing for the leasing of park- ing meters dated May 8, 1951, shall be, and it is hereby, modified and changed to read as follows~ "1. To lease to the City Eight Hundred (800~ Miller Manua~ Multiple-coin parking meters (hereinafter called 'meters'~, at an agreed value of Sixty-four Dollars ($65.00~ per meter, (~ltiple-coin to he one penny, one nickel, one dime, two nickels and ten penny of the two hour accumulative type, excepting that 150 of said parking meters shall be one. nickel multiple-coin of the ten hour accumulative type~o~ which paragraph.l, as change~, shall he considered as part of said agreement, dated ¥~y 8, 1951, otherwise said agreement and all provisions thereof to ~emain in full force and effect. IN WITNESS WHEREOF. the parties hereto have executed this agreement the date and year ~irat above written. Section 2. This ordinance is hereb~eclared to be an emergency measure for the reasons stated in the preamble hereof and, provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
