ORDIN~ EE NOo h787 <br /> <br />BY Nr. Gottermeyer <br /> <br /> AN E~,~RG~NEY ORDINANCE authorizing the Director cf Finance to pay Peter A. Pich <br />the sum of Sixty Dollars ($60.00) in full cf all property damages to his automobile <br />and of all personal injuries suffered by Peter A. Pich and his daughter Nary Margaret <br />Pich, resulting from the accident hereinafter described, as a moral claim. <br /> WHEREAS, the automobile belonging to and operated by Peter A. Pich in which his <br />minor daughter Nary Margaret Pich was riding as a passenger collided with Police ~ar <br />No. 53 o~ or about November 27~ 1950, o~ Warren Road in the City of Lakewood, causing <br />some iuj.uries and damages to the automobiles, and <br /> <br /> WHEREAS, it is the opinien of this ~mncil that Officer Paul Euprik, Jr., was <br />engaged in a Governmental function iu operating theEity-o~ned automobile ~nown as <br />Police Ear No. 53 at the time cf the resulting injuries and damages, for which reas~ <br />it considers that the Eity cf Lakewood incurred no legal obligation to either Peter <br />A. Pich or to Nary Margaret Pich, but nevertheless desiring to reimburse them for <br />expenses by reason thereof, and <br /> <br /> ~p~_~w~M, this ordinance constitutes an emergency, in that settlement may be <br /> made forthwith, and in that this ordinance provides for the usual daily operation of <br /> a municipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE ~O~N~IL OF THE :DITY OF IAi~I00D, STATE OF OHI0: <br /> <br /> Section lo That the Director of Finance be and he is hereby authorized and <br />directed to pay to Peter A. Pich the sum of Sixty Dollars ($60.00) as a moral claim <br />in full of all property damage suffered by Peter A. Pich and in full of all claims <br />for personal injuries suffered by Peter A. Pich and his minor daughter, }~mry Margaret <br />Pich, conditioned, however, upon the execution and delivery by Peter A. Pich of a <br />full release iu favor of the .Eity of Iakewood and Paul Euprik, Jr., duly approved by <br />the Director of Law; any and all actions by Peter A. Pich as father and next friend <br />of Nary Nargaret Pich as a condition precedent to settlement of the claim as herein <br />authorized being hereby expressly waived. The Director of Finance is authorized and <br />directed to charge such ps~mant to the General Fund - General Miscellaneous. <br /> <br /> Section 2. This ordinauce is hereby declared to be an emergency measure f~r <br />the reasons stated in the preamble hereofand, provided it receives the affirmative <br />vote of two-thirds of all members elected to Council, it shall take effect and be in <br />force immediately upon its adoption and approval by the Mayor. <br /> <br />Adopted: ~V 5- 1951 <br /> <br />Approved: ~? ~ t/~¢~/ <br /> <br />president <br /> <br /> <br />
