<br />/ AN ~GENCY ORDI~NCE authorizing the Mayor, on behalf of the City of
<br />/ Lakewood, Ohio, to enter into a contract with the Cleveland Electric Illuminating
<br /> Company for electric street lighting in the City of Lakewoodo
<br />
<br /> ~HEP~, on July 21, 1952, Resolution No. 3524 was adopted by the Council
<br />of the City of Lakewood, wherein authority was given to the Mayor as Director of
<br />Public Works to advertise for bids for furni~ing the City of Lakewood with street
<br />lights and current thereto, and,
<br />
<br /> WHEREAS, such advertisement was inserted in the Suburban News, August 1st
<br />and 8th, 1952; bids received at 11:00 A. Me, Eastern Daylight Saving Time, Monday,
<br />August 18, 1952, and the bid ef the cleveland Electric IllUminating Company was
<br />the only bid received for furnishing this service, and,
<br />
<br /> 'w~tEAS, the bid was submitted to and approved by the Council, at its
<br />meeting September 2, 1952, and,
<br />
<br /> WHEREAS p this ordinance constitutes an emergency in that the proposed
<br />contract pursuant to said award is to become effective October 1, 1952, in order
<br />that electric street lighting may be continued uninterrupted and in that it
<br />provides for the public health, welfare and safety and the usual daily operation
<br />of a municipal department, now, therefore,
<br />
<br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF IAKEWOOD, STATE OF OHIO:
<br />
<br /> Section 1. That the Mayor be ama he is hereby authorized on behalf of
<br />the city, to enter into a contract with the Cleveland Electric Illuminating
<br />Company, in form substantially as follows:
<br />
<br /> "This Agreement entered into this day of September, 1952
<br /> by and between the City of Lakewoo ~,~o, an Ohio municipal
<br /> corporation, by its Mayor thereunto duly authorized by Ordinance
<br /> No. of the Council of said city, adopted on the day
<br /> of ~'~'~mber, 1952, as party of the first part and the--~veland
<br /> Electric Illuminating Company, the Contractor, as party of the
<br /> second part.
<br />
<br />WITNESSETH:
<br />
<br />That the parties hereto have agreed and by these presents de
<br />mutually agree as follows:
<br />
<br />1. That the second party agrees to supply and maintain and the
<br />first party agrees to pay for electric street lighting in said
<br />City of Lakewood for a period of five years from and after
<br />12:00 otclock noon of October 1, 1952 and ending at 12:00
<br />o' clock noon October 1, 1957, in accordance with the notice to
<br />bidders, the specifications for electric street lighting, dated
<br />July 17, 1952 and the lamp location plat, which are on file in
<br />the office of the Mayor-Ex-officio Director of Public Works of
<br />the City of Lakewood, a copy of which notice, specifications and
<br />plat are attached hereto and made a part hereof.
