<br /> AN EM~RGENCY ORDINANCE authorizing the Mayor, on behalf of the City of
<br />Lakewood, to enter into an agreement f_th Hays & Ruth, as Architects, for plan prep-
<br />aration and construction of additional hospital facilities as hereinafter provided.
<br />
<br /> ~EREAS, this ordinance constitutes an emergency in that the electors of
<br />the City of Lakewood authorized a bend issue for the purpose of further construction
<br />at Lakewood Hospital; in that said bonds have been authorized byco,~ncil and sold;
<br />in that the public health and welfare requires immediate action for the construction
<br />of additional hospital facilities; and in that it provides for the usual daily oper-
<br />ation of the municipal department; now, therefore,
<br />
<br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LA~WOOD, STATE OF OHIO:
<br />
<br /> SectiOn 1- That theMayor be, and he is hereby, authorized on behalf of the
<br />City of Lakewood, to enter into an agreement with Hays & Ruth, ArchiteCts, which
<br />agreement, hereby approved, shall read substantially as follows:
<br />
<br />SUPPLEMENTAL AGEEE~ENT
<br />
<br /> THIS SUPPL~AL AGR~Ew~E. NTmade the day of April, 1952 by and between
<br />Hays & Ruth, 1720 Euctmd AVenue, Cleveland 15'~o, hereinafter calle~ the
<br />"Architect", and The City of Lakewood, a municipal corporation under the laws of
<br />the State of Ohio, hereinafter called the .Owner., Witnesseth:
<br />
<br /> WHEREAS, Conrad, Hays, Simpson and Ruth, 1110 Hanna Building, Cleveland 15,
<br />Ohio, and the Owner entered into an Agreement, dated March 21, 1947 relating to
<br />additions and alterations to Lakewood Hospital, which Agreement and all interests
<br />therein were assigned to Hays & Ruth, 1720 Euclid Avenue, Cleveland 15, Ohio, said
<br />assignment being consented to by the City of Lakewood pursuant to Ordinance No.
<br />4804, adopted by the Council, February 18r 1952; and
<br />
<br /> WHEREAS, all or substantially all of the work contemplated pursuant to said
<br />agreement and for which bids were let, has been completed; and
<br />
<br /> WHEREAS, the Owner desires to proc-eedwith alterations, a portion of which
<br />as contemplated in th? Agreement of Narch 21, 1947 having been excluded in the
<br />awarding Of constructmon bids; now, therefore,
<br />
<br />IT IS MUTUALLY AGREED AS FOLIOWS:
<br />
<br /> 1. The Owner employs the Architect to perform, and the Architect agrees to
<br />perform to the satisfaction of the Owner, professional services necessary and inci-
<br />dent to (a)alterations to provide ventilation in the blower room of the pneumatic
<br />tubs system; (b) alterations to provide ventilation in the kitchen, store rooms and
<br />laundry; and (c) alterations within and leading to that portion of the hospital
<br />building which is constructed along Detroit Avenue in the City of Lakewood. The
<br />Owner reserves and shall have the right to consider and treat the foregoing alter-
<br />ation items as alternates and eliminate such ones thereof as it may consider
<br />necessary.
<br />
<br /> 2. The Architect agrees to perform for the above-named work, professional
<br />services as follows:
<br />
<br />(a) All necessary conferences and the preparation of preliminary studies
<br />and plans for all alterations.
<br />
<br />(b) The preparation of all necessary working drawings, small and large
<br />scale detail drawings, specifications, estimates of cost and the drafting
<br />of forms of proposals and agreements for the purpose of obtaining building
<br />construction bids.
