ORDINANCE NO. 4829 BY Nrc Gottermeyer <br /> <br /> AN ORDINANCE authorizing the Mayor, ex-officio Director of Public Works, <br />on behalf of the City of Lakewood, Ohio, to enter into a lease with the City <br />Products Corporation of the premises hereinafter more specifically described, for <br />playground purposes. <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF IAK~¥0OD, STATE OF OHIO: <br /> <br /> Section le That the Mayor, ex-officio Director of Public Works be, and he <br />is hereby, authorized and directed to enter into a lease with City Products Corp- <br />oration, reading substantially as follows: <br /> <br /> ~THIS LEASE made at Cleveland, Ohio, this day of May, 1952, <br />by aud between City Products Corporation its successors and assigns, <br />hereinafter called the Lessor and the City of Lakewood, a municipal <br />corporation duly organized and existing under and by virtue of the <br />laws of the State of Ohio, hereinafter called the Lessee, <br /> <br />WI T NE SSETH: <br /> <br /> That the Lessor does hereby let and lease unto the Lessee the <br />premises situated in the City of La~ewood, County of Ouyahoga and <br />State of Ohio, being part of original Rockport Township, Section <br />NCo 19, and further bounded and described as follows: <br /> <br />Beginning at the northwesterly corner of a parcel of land con- <br />veyed to the City Ice and Fuel Company by deed dated May 2, 1922, <br />and recorded in Volume 2619, Page 154, of Cuyahoga County Deed <br />Records; thence from said place of beginning easterly along the <br />northerly line of said parcel 211.O0 feet; thence southerly <br />about 235 feet to a point in the northerly line of Lakewcod Heights <br />Boulevard at a point distant 211.O0 feet easterly from the south- <br />westerly corner of said parcel of land so conveyed to the City Ice <br />and Fuel Company; thence westerly along the northerly line of <br />Lakewood Heights Boulevard 211.00 feet to the southwesterly corner <br />of said City Ice and Fuel Company land; thence northerly along <br />said westerly line about 235 feet to the place of beginning. <br /> <br /> The above described premises shall be occupied and used by the lessee for <br />playground purposes only. <br /> <br /> TO HAVE AND TO HOID unto the Lessee for the term beginning June 1, 1952 and <br />ending Septembsr 30, 1952, upon the covensnts~and agreements herein set forth. <br /> <br /> The Lessee covenants and agrees to pay to the Lessor as rent for said prem- <br />ises during said term, the sum of One Dollar ($1eO0) payable in advance to the <br />office of the Lessor; and the Lessee further covenants and agrees that it has <br />received the p~emises in good order and repair, and will surrender the pos- <br />session thereof te the Lessor on September 30, 1952 in as good condition and <br />repair as the said premises shall be on June 1, 1952. <br /> <br /> Further the Lessee, in consideration of the foregoing demise, covenants <br />and agrees with the Lessor, its successors and assigns, that the Lessee will <br />indemnify the Lessor, its successors and assigns, and save them harmless and <br />defend them against any and all claims, demands, damages, costs, loss, expense <br />and liability for any injury or damage to person or property, or otherwise, <br />arising or claimed to arise in any manner out of the Lesseets occupancy or <br />use of the demised premises. <br /> <br /> IN WITNESS WHEP~OF the parties hereto have set their hands to duplicates <br />hereof, the day and year first above written." <br /> <br /> <br />
