0RDTNANCE N0~ 4838 BY Mr. Fairgrieve AN K~ERGENCY ORDINANCE restricting the cutting or lowering of curbs; fixing the amount cf charges by the City cf Lakewood for cutting or lowering curbs; re- quiring a deposit; and repealing Ordinance Nco 4197~ WH~, an emergency exists in that costs for the cutting or lowering of curbs have increased substantially above charges heretofore authorized; in that, to save the City from continuing losses, charges for such services must be immediately increased to cover the cost thereof; and in that this ordinance makes provision therefor and for the public welfare and safety and the usual daily operation of a m~nicipal department,, now, %herefore~ BE IT ORDAINED BY THE COUNCIL OF THE CIT! OF LAKEWOOD, STATE OF OHIO: Section le Excepting the State of Ohio, the County of Cuyahoga er a Contractor, pursuant to agreement with the City of Lakewocd~ no persou shall cut or lower curbs within the City other'than the Division of Streets~ Sewers and Side- malks~ Upon applicatiom therefor, together with deposit to cover the estimated cost~ and determination by the Superintendant of said Division that such cutting or lower- ~ of curbs as applied fcr~ will not interfere with the l~oper use of the street~ the Division of Streets, S~.=rs and Sidewalks shall cut or lower curbs and charge therefor as follows: 1. F°r cutting sandstone curb, the charge shall be 50 cents per lineal feet with a ~ztnimum charge ef $3.00 under each application; 2. For cutting concrete or granite curb, the charge shall be 75 cents per lineal foot with a minimum charge of $3.00 under each application; and 3. For lowering curh the charges shall be the actual cost to the City ~'nd the minimum deposit required shall be $3e00 per lineal foot under each application~ Costs shall be computed at the rate of wages and truck hire as fixed by ordinances at the time the work is donee Deposits made in excess of actual cost as hereinbefore provided shall be refunded by the City to the depositor thereof upon completion and determination of the cost of the werke Section 2. This ordinance is hereby deClared to be an emergency measure for the reasons stated in the preamble hereof and Provided it receives the affirma- tive vote of twb,thirds of all members elected to Council, it shall take effect and he ~n force ~mmediately upon its adoption, and Ordinance No. 4197 shall be, and it is hereby, repealede ~., ...
