ORDINANCE NO, 4841 BY Mr. Fairgrieve <br /> <br /> AN EMERGENCY ORDINANCE authorizing the settlement of the claim of Mrs. <br />Eathry~ D. Boysen, ~ridow, for personal injuries, damages and expenses incurred by <br />reason of falling on an alleged defective sidewalk. <br /> <br /> WHEHEAS, Mrs. Kath~-~n Do Boysen incurred personal injuries on or about <br />October 17, 1950 at abont 11:45 A. M. o, clock in front of or near 17701 Detroit <br />Avenue by reason of falling on an alleged defective sidewalk, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency in that in order to save <br />the City from litigation, unnecessary expense, an~ possible additional obligations, <br />it authorizes the immediate settlement and adjustment of said claim arm ~rovides <br />for the usual dail~ operation of a municipal department, now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAHEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That settlement of the claim of Mrs. Kathryn D. Boysen for the <br />sum of One Hundred and Seventy Five Dollars ($175o00) is hereby authorized, condi- <br />tioned upon the execution and delivery by Kathryn D. Boysen of a full release in <br />favor of the City of Lakewood duly approved by the Director of Law. <br /> <br /> Section 2, That the Director of Finance be, and he is hereby, authorized <br />and directed to pay the sum of One Hundred and Seventy Five Dollars ($175.00) to <br />Mrs. Kathryn D. Boysen upon delivery to him of the foregoing release duly executed <br />and approved, and to charge the same to the General Fund - Damages Paid by the City. <br /> <br /> Section 3. This ordinance is hereby dgclared to be an emergency measure <br />for the reascns stated in the preamble hereof and, provided it receives the affirm- <br />ative vote of two-thirds of all members elected to Council, it shall take effect <br />and be in force fmmediately upon its adoption and approval by the Mayor. <br /> <br />Adopted: <br /> <br />June 16~ 1952 <br /> <br />George F.
