ORDINANCE NO, 4841 BY Mr. Fairgrieve AN EMERGENCY ORDINANCE authorizing the settlement of the claim of Mrs. Eathry~ D. Boysen, ~ridow, for personal injuries, damages and expenses incurred by reason of falling on an alleged defective sidewalk. WHEHEAS, Mrs. Kath~-~n Do Boysen incurred personal injuries on or about October 17, 1950 at abont 11:45 A. M. o, clock in front of or near 17701 Detroit Avenue by reason of falling on an alleged defective sidewalk, and WHEREAS, this ordinance constitutes an emergency in that in order to save the City from litigation, unnecessary expense, an~ possible additional obligations, it authorizes the immediate settlement and adjustment of said claim arm ~rovides for the usual dail~ operation of a municipal department, now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAHEWOOD, STATE OF OHIO: Section 1. That settlement of the claim of Mrs. Kathryn D. Boysen for the sum of One Hundred and Seventy Five Dollars ($175o00) is hereby authorized, condi- tioned upon the execution and delivery by Kathryn D. Boysen of a full release in favor of the City of Lakewood duly approved by the Director of Law. Section 2, That the Director of Finance be, and he is hereby, authorized and directed to pay the sum of One Hundred and Seventy Five Dollars ($175.00) to Mrs. Kathryn D. Boysen upon delivery to him of the foregoing release duly executed and approved, and to charge the same to the General Fund - Damages Paid by the City. Section 3. This ordinance is hereby dgclared to be an emergency measure for the reascns stated in the preamble hereof and, provided it receives the affirm- ative vote of two-thirds of all members elected to Council, it shall take effect and be in force fmmediately upon its adoption and approval by the Mayor.
