<br /> ~N ORDINANCE to regulate and fix the prices ~d terms upon which The
<br />East Ohio Gas Company, its successors and assigns, shall be required to furnish
<br />natural gan to the City of Lakewood, Ohio and its inhabitants.
<br />
<br /> zH~'R~S, The East Ohio Gas Compa~ly is the lawful successor to the
<br />original The East Ohio Gas Con~a~y to which was granted the right to enter upon
<br />the streets, alleys and public grounds of the City of Lakewood for laying and
<br />maintaining gas mains, pipes and other appliances for the purpose of supplying
<br />natural gas to the City of Lakewood ~d its inhabitants as recited in Ordinance
<br />No. 511, adopted December 2, 1~07; and
<br />
<br /> .~HER. L~., this council desires to enter into a contract regulating and
<br />fixing the prices and terms upon which The Vast Ohio Gas Compm~y :-hall furnish
<br />natural gas; now, therefore~
<br />
<br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, ~t.~%E OF OHIO:
<br />
<br /> Section 1. ~erever in this ord~%m~ce the term "the Company" is used
<br />it shall be understood ~d intended to mom3 The East Ohio Gas Oomph%y, and wherever
<br />the term "city" is used~ it shall be understood and intended to mean the City of
<br />Lakewood, Ohio, a municipal corporation.
<br />
<br /> Section 2. The service lines from the mains and pipes of the Company
<br />to the curb ~d curb box shall be installed and maintained at the expense of the
<br />Compa~ly, and the Company shall, at its own cost and expense, supply and maintain
<br />all meters and regulators and they shall be of standard make.
<br />
<br /> Section 3. The Company shall extend its pipes m~d mains for the fur-
<br />nishing of natural gas to and upon any dedicated street, avenue, highway, alley,
<br />public ground or a~kvpart thereof within the li~ts of said City whenever at least
<br />one (1) consumer on an average for each additional one hundred (100) feet of pipe
<br />in the street or streets in which the extension is to be run, shall first in writing
<br />agree to take a supply of natural gas at the then established rate, measurement to
<br />be taken from the end of the nearest low pressure line; provided, however, that
<br />the Co~ga~ shall not be required to make a~ky extensions during the months of
<br />December, January, February end March o£ any year.
<br />
<br /> Section 4. The term "natural gas" as used herein is intended to mean
<br />natural gm~ of the quality and character produced by nature in the petroleum,
<br />oil and natural gas fields of West Virginia and Ohio, or elsewhere, which natural
<br />gas is to be furnished in its natural state without mixture of air, the abstraction
<br />of a~lynatural elements or adulteration, at the consumer's meters mabject, however,
<br />to the removal of oil m~d gasoline vapors; provided, however, that natural gas
<br />furnished or delivered pursuant to the terms of this ordinance shall always have
<br />a heat value of ~t less than ~00 British thermal units per cubic foot at 14.6
<br />pounds per square inch absolute pressure (4 ounces per square inch above atmospheric
<br />pressure at 14.35 pounds per square inch) 60 degrees te~oerature Fahrenheit (520
<br />degrees absolute) and .6 specific gravity. Tests to dster~ine the British thermal
<br />units may be made from time to time in the city limits by said City through repre-
<br />sentatives duly authorized by council.
<br />
<br /> Section 5. PRFi~'ER~iCES. If at a~ty time during the term of this ordinance
<br />the C~mpa~y is unable to obtain a full supply of natural gas, the amount which the
<br />Company does obtain shall be fairly apportioned among the municipalities which the
<br />Company is under obligation to supply.
<br />
<br /> In the event of a shortage of the supply of natural gas, the Co~r:pany
<br />sh~ll, during the e~r, ergency, supply natural gas' in an order of preference b~ed
<br />upon the following specifications.
<br />
<br /> First Class. The domestic consumer which shall include the users of
<br />natural gas for such purposes as cooking, lighting a~d heating in pri~ate homes,
<br />boarding houses and apartment houses; the users of natural gas for lighting and
<br />cooking only in hotels, restaurants, bakeries, eating places, club houses, public
<br />schools, parochial schools, private schools, hospitals and charitable institutions,
<br />and in places of like kind where the ele~e~ of hm~an welfare is the predo~*inating
<br />requirement.
