ORDINANCE NO. 11-58 BY: Messrs. Fairgrieve, Gaydos, Gottermeyer, Lawther, Ward, Choekley. AN EMERGENCY ORDINANCE authorizing settlement of the claim of Theresa Greene and Richard Greene in the total amount of seven hundred fifty dollars, arising from a fall of Theresa Greene on the northerly sidewalk of Plover Avenue a short distance west of Quail Street, Lakewood, Ohio. WHEREAS, This ordinance constitutes an emergency in that it may save the city from further expense and expensive litigation in that it provides for the immediate settlement of said claim, and in that it provides for the usual operation of a municipal department, now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: . Section 1. That settlement of the claim of Theresa Greene and Richard Greene wife and husband, in the amount of seven hundred fifty dollars, is 'ereby ordered and authorized, conditioned upon the execution and delivery by Theresa Greene and Richard Greene of a full release in favor of the City of Lakewood, duly approved by the di- rector of law. Section 2. That the director of finance be and he is hereby authorized to pay the sum of seven hundred fifty dollars to Theresa Greene and Richard Greene, upon delivery to the director of finance of the foregoing release duly executed and approved; and to charge the same to the General Fund - Damages Paid by the City. Section 3. This ordinance is hereby declared to be an emer- gency measure for the reasons stated in the preamble hereof, and pro- vided it receives the affirmative vote of two-thirds of all members elected to council, it shall take effect and be in force immediately upon its adoption and approval by the mayor.
