Chockley, Fairgrieve, <br /> Gaydos, Gottermeyer, <br /> Lawther, Ward. <br />AN EMERGENCY ORDINANCE authorizing the Mayor, as Director of <br />Public Works, to .nter into an agreement with The New York, Chicago <br />and St. Louis Railroad Company, covering the construction of a storm <br />sewer by the City of Lakewood on said railroad's right-of-way between <br />St. Charles ,Aven\le and Cook Avenue in the City of Lakewood. <br />WHEREAS An emergency exists in that the storm sewer system <br />in the area of Óook-Warren-St. Charles Avenues is presently inadequate <br />and it i. necessary that larger storm sewer facilities be installed <br />at the earliest possible time, and that the installation of such <br />facilities are necessary for the immediate preservation of the public <br />peace, property, health or aafety. now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO: <br />Section 1. That the Hayor be and he is hereby directed to <br />enter into an agreement with The New York, Chicago and 8t. Louis <br />Railroad Company for the right to construct, usein bintain. renew, <br />and remove one storm sewer, consisting of an 18 ch diameter pipe <br />between Cook Avenue and Warren Road. and a 15 inch diameter pipe be- <br />tween Warren Road and St. Charles Avenue, upon and along the right of <br />way of the Railroad Company's Nickel Plate District, at Lakewood, <br />Cuyahoga County Ohio, as shown upon said railroad's plans dated <br />February 4, 1958 and numbered L-l90.6 and L-190.8. which are attached <br />and made a part of said license agreement and further subject to the <br />terms and conditions contained in such license agreement. <br />That the .onsideration to be paid for such license agreement <br />by the City of Lakewood is the ewn of one dollàr. <br />Section 2. This ordinance is hereby declared to be an emer- <br />gency measure for the reasons stated in the preamble hereof, and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council. it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor. <br />Adopted:_March 17. 19;8 Thomas C.
