space in the Cuyahoga County Jail is not available. In con- <br />sideration ~hereof, while this contraCt continues, the said <br />first party shall pay to the Board of CoUnty Commissioners <br />of Cuyahoga CoUnty for the housing and safe keeping of said <br />prisoner and his care, maintenance and feeding st the rate of <br />four dollars and twenty-five cents ($4.2~) per day for each <br />day he remains in said Jail. <br /> <br />IT IS FURTHER A~EED that the party of the first part shall <br />pay to the party of the second part the cost at the rate <br />indicated for the keeping of prisoners at the expiration of <br />each month upon the presentation of properly itemised bills. <br />it is agreed that the number of days t° be charged for each <br />prisoner so COmMitted to said Jail by the aUthorities of <br />said municipality Shall be determined by taking a census <br />of such prisoners each twenty-four hours at the hour of <br />midnight, and that the said municipality shall pay the rate <br />~er day multiplied by the number of its prisoners in such <br />ail at each such census hour. It is also agreed that the <br />payment to be made as above provided shall be in full of all <br />services rendered and is agreed to include the actual cost, <br />~ithin the limitations prescribed by Section 311.20 of the <br />Revised Code of Ohio for feeding such prisoners and the <br />actual cost incurred by said second party for receiving, <br />maintaining, and safely keeping said prisoners above <br />scribed, provided, however, that in the event it becomes <br />necessary in the Judgment of the sheriff that any such <br />prisoners received in said Jail shall be hospitalised by <br />reason of illness or injury, the cost of such hospitalisa- <br />tion shall become the obligation of the first party and <br />shall be paid by it. <br /> <br />THIS A~REEMENT shall be in force and effect for a period of <br />one year from and after the 1st day of August, 1958, and may <br />.be ~erminated by either party at its option by giving ninety <br />(90) days notice in writing of its intention so to do. <br /> <br />IN WITNESSh~EREOF, <br />at Cleveland' Ohio, <br />19~8. <br /> <br />the parties hereto have set their hands <br />this.___.____day of ......... , <br /> <br /> Section 2.
