Copy <br /> <br />ORDINANCE NO. 50-58 <br /> <br />Messrs. <br /> <br />Fairgrieve, Gaydos, <br />Gottermeyer, Ward, <br />Chockley, Fahrenbach. <br /> <br /> AN EMERGENCY ORDINANCE determining to proceed with the improving <br />of Lauderdale Avenue from Detroit Avenue to Madison Avenue by resurfac- <br />ing same with asphaltic concrete and doing any or all grading, draining, <br />and curbing or other work necessary thereto. <br /> <br /> WHEREAS, Article V, Section 3 of the Charter of the City of <br />Lakewood requires that Council shall by ordinance determine whether <br />public improvements shall be made by direct employment of labor and <br />the purchase of the necessary supplies and material, or by contract, <br />and <br /> <br /> WHEREAS~ Upon consideration thereof, this Council determines it <br />in the interests of the City of Lakewood to improve Lauderdale Avenue <br />from Detroit Avenue to Madison Avenue by contract rather than by direct <br />employment of labor and the purchase of the necessary supplies and <br />material, and <br /> <br /> WHEREAS, This Council considers it in the interests of the City <br />of Lakewood that the contract be entered into at the earliest possible <br />time and designate this ordinance as necessary for the immediate <br />preservation of the public peace, property, health or safety, and that <br />it provides for the usual daily operation of a municipal department, <br />now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Council determines that the improving of <br />Lauderdale Avenue from Detroit Avenue to Madison Avenue shall be done <br />by the department of public works, by contract rather than by the <br />direct employment of labor and the purchase of the necessary supplies <br />and material. <br /> <br /> Section 2. That this ordinance is hereby declared to be an emer- <br />gency measure for the reasons stated in the preamble hereof, and pro- <br />vided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor. <br /> <br />Adopted:.
