Common Pleas Court Case No. 3023~.7; thence North 18 degrees -45' -42" West, 213.20 feet measured along the southwesterly line of land appropriated, as aforesaid; thence North 3 degrees -16' -19" East, 129.97 feet; thence North 8 degrees -27' -08" West, 187.16 feet; thence North 6 degrees -04' -52" West~ lO0.91 feet; thence North 19 degrees -08, -~8,' East, 53~00 feet measured along the northeasterly line of land conveyed to the Board of Park Commissioners of the Cleveland Metropolitan Park Board, as aforesaid, to the northeasterly corner thereof and the southerly line of the bridge approach as aforesaid; thence South 70 de- grees -51' -22" East, 586.52 feet; thence South 64 degrees -36' -54" West, 75.97 feet; thence South 36 degrees -17' -22" West, 69.57 feet;~hence South 53 degrees -42' -38" East, 80.00 feet to the principal point of beginning. Containing 243,389.17 square feet'more or less, but subject to all legal highways, re- strictions of record and easements, if any, and also subject to taxes for the year 1958 and thereafter, and zoning ordinances; portions of the said premises are occupied on a month to month tenancy by the following persons~ United Moving and Storage Harold Stills John P. The Vendee hereby agrees to purchase and pay for said above de- scribed premises the sum of' one hundred fifty five thousand dollars, upon delivery to Vendee of an official deed of the City of Cleveland and a title guaranty in the amount of the purchase price, both of which instruments show that the conveyance is being made subject only to taxes for the year 1958 and there- after, zoning ordinances, restrictions of record and easements, if any. That rentals for the portion of such real estate occupied by said tenants, and taxes, shall be pro-rated as of the date of delivering the said official deed to Vendee; all assessments shall be paid by Vendor; it is specifically understood, however, that in view of the fact that the Vendor has been notified to replace the public sidewalk abounding the above described property, that if in fact such sidewalk is installed by the Vendor, or by the City of Lakewood at the cost of the Vendor, that the Vendee shall pay the cost of such sidewalk in addition to the said purchase price. Vendor shall pay the cost of title examination and title guar- anty; one-half the escrow fee, if any. The Vendee shall be charged one-half the escrow fee, if any. Within thirty days after delivery of said deed and the payment of the purchase price, Vendor shall pay to the City of Lakewood the sum due it under pro-ration of taxes and rentals; tax valu- ation for purpose of pro-ration shall be determined by the Mayor and the Cleveland Transit System.
