Copy ORDINANCE NO. 73-58 Messrs. Ward, Chockley, Fahrenbach, Gaydos, Gettermeyer, Lawther. AN EMERGENCY ORDINANCE authorizing and directing the Mayor, on be- half of the City of Lakewood, to employ Squire, Sanders and Dempsey, Attorneys at Law, to consider the legal aspects cf and to prepare all instruments necessary for the issuance of revenue bonds for the purpose of acquiring and constructing off-street parking areas in the Warren- St. Charles area and the Highland Avenue area. WHEREAS, By Ordinance Nos. 71-58 a~d 72-58, an agreement with Wm. J, Mericka and Co., Inc. was authorized for the making of surveys, reports and recommendations relative to off-street parking, and WHEREAS~ It is advisable to have the bond counsel advise and co- operate with the said Wm. J. Mericka and Co., Inc, in the preparation ef surveys, reports and recommendations relative to off-street parking, and WHEREAS, An emergency exists for the reasons that in order to effectuate the said preparation of surveys, reports and recommendations, and to_provide financing for the off-street parking facilities in the Warren St. Charles area and the Highland Avenue area, and to provide for the public safety and welfare and the usual daily operation efa municipal department, it is necessary to immediately provide for the preparation of further necessary legislation, agreements, bonds and other instruments, now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor be and he is hereby authorized and di- rected to employ Squire, Sanders and Dempsey to prepare all legislation, agreements, bonds and other instruments as may be necessary and inci- dent to the issuance of revenue bonds to provide financing for the pur- pose of acquiring the realty heretofore proposed by Council for the Warren-St. Charles area and the Highland Avenue area, for off-street parking facilities and for the construction and operation of &Ff-street parking areas thereon. Ail compensation for such services shall be paid from proceeds received from the sale of the revenue bonds, if such bonds are not sold, from the General Fund - General Miscellaneous Appropriation. Section 2. That this ordinance is hereby declared to be an emer- gency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
