Ward, Chockley, <br /> Fahrenbach, Gaydos, <br /> Gettermeyer, Lawther. <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor, on be- <br />half of the City of Lakewood, to employ Squire, Sanders and Dempsey, <br />Attorneys at Law, to consider the legal aspects cf and to prepare all <br />instruments necessary for the issuance of revenue bonds for the purpose <br />of acquiring and constructing off-street parking areas in the Warren- <br />St. Charles area and the Highland Avenue area. <br /> <br /> WHEREAS, By Ordinance Nos. 71-58 a~d 72-58, an agreement <br />with Wm. J, Mericka and Co., Inc. was authorized for the making of <br />surveys, reports and recommendations relative to off-street parking, <br />and <br /> <br /> WHEREAS~ It is advisable to have the bond counsel advise and co- <br />operate with the said Wm. J. Mericka and Co., Inc, in the preparation <br />ef surveys, reports and recommendations relative to off-street parking, <br />and <br /> <br /> WHEREAS, An emergency exists for the reasons that in order to <br />effectuate the said preparation of surveys, reports and recommendations, <br />and to_provide financing for the off-street parking facilities in the <br />Warren St. Charles area and the Highland Avenue area, and to provide <br />for the public safety and welfare and the usual daily operation efa <br />municipal department, it is necessary to immediately provide for the <br />preparation of further necessary legislation, agreements, bonds and <br />other instruments, now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br />OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby authorized and di- <br />rected to employ Squire, Sanders and Dempsey to prepare all legislation, <br />agreements, bonds and other instruments as may be necessary and inci- <br />dent to the issuance of revenue bonds to provide financing for the pur- <br />pose of acquiring the realty heretofore proposed by Council for the <br />Warren-St. Charles area and the Highland Avenue area, for off-street <br />parking facilities and for the construction and operation of &Ff-street <br />parking areas thereon. <br /> <br /> Ail compensation for such services shall be paid from proceeds <br />received from the sale of the revenue bonds, if such bonds are not sold, <br />from the General Fund - General Miscellaneous Appropriation. <br /> <br /> Section 2. That this ordinance is hereby declared to be an emer- <br />gency measure for the reasons stated in the preamble hereof and provided <br />it receives the affirmative vote of two-thirds of all members elected <br />to Council, it shall take effect and be in force immediately upon its <br />adoption and approval by the Mayor. <br /> <br />Adopted: Augusb 8, 1958 <br /> <br />Approved:....
