ORDINANCE NO. 76-58 BY~ Messrs. Fahrenbach, Fairgrieve, Gottermeyer, Lawther, Ward, Chockley. AN EMERGENCY ORDINanCE approving certain change orders in con- nection with the construction of the municipal departments and adminis- tration building. WHEREAS, Council has heretofore authorized the Mayor, as Director of Public Works, to enter into an agreement with Brown Construction Company for the construction of a municipal departments and administra- tion building, and WHEREAS, Under the terms of such agreement, there were certain provisions applicable to change orders, and WHEREAS, Council desires to take advantage of certain change orders provided in such agreement, and WHEREAS, The completion of said municipal departments and admin- istration building is desirable at the earliest possible time, and WHEREAS, The adoption of this ordinance at the earliest possible time is necessary for the preservation of the public peace, property, health or safety, and that it provides for the usual daily operation of a municipal department, now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEW00D, STATE OF 0HIO: Section 1..That the items described in Bulletin No. l, prepared by Garfield, Harris, Schafer, Flynn & Wmlliams, Architects, be added to the contract hereinbefore entered into by the City with the Brown Construction Company, with reference to the construction of a municipal departments ~nd administration building at 12650 Detroit Avenue, Lakewood, Ohmo~ and that the net cost of the change orders contained in said Bulletin No. i is in the amount of $169,158.00; that said ad- ditional construction has been generally referred to as the civic center. Section 2. That the Mayor, as Director of Public Works, is hereby authorized and directed to approve said change orders. Section 3. That the net cost of such change orders, in the amount of $169,158.00, be financed out of the proceeds of the sale of the municipal departments and administration building bonds. Section 4. That this ordinance is hereby declared to be an emer- gency measure for the reasons stated in the preamble hereof, and pro- vided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
