ORDINANCE NO. 90-58 BY: Messrs. Gaydos, Gottermeyer, Lawther, Ward, Chockley, FahrenbaCh. AN ~ERGENCY ORDINANCE authorizing settlement of the claim of Mary E. Ramney, in the.total amount of two hundred dollars, arising out of a fall on the smd~walk at the northwest corner of Carabel Avenue and Lakewood Heights Blvd., Lakewood, Ohio, on July 25, 1958. WHEREAS, This ordinance constitutes an emergency in that it may save the City from further expense and possible litigation in that it provides for the immediate settlement of said claim, and in that it provides for the usual operation of a municipal department, now, there- fore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That settlement of the claim of Mary E. Rainey in the amount of two hundred dollars is hereby ordered and authorized, conditioned upon the execution and delivery by Mary E. Rainey of a full release in favor of the City of Lakewood, duly approved by the Director of Law. Section 2. That the Director of Finance be and he is hereby authorized to pay the sum of two hundred dollars to Mary E. Rainey, upon delivery to the Director of Finance of the foregoing release duly executed and approved; and to charge the same to the General Fund - Damages Paid by the City. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
