ORDINANCE NO. 90-58 <br /> <br />BY: Messrs. <br /> <br />Gaydos, Gottermeyer, <br />Lawther, Ward, <br />Chockley, FahrenbaCh. <br /> <br /> AN ~ERGENCY ORDINANCE authorizing settlement of the claim of <br />Mary E. Ramney, in the.total amount of two hundred dollars, arising <br />out of a fall on the smd~walk at the northwest corner of Carabel Avenue <br />and Lakewood Heights Blvd., Lakewood, Ohio, on July 25, 1958. <br /> <br /> WHEREAS, This ordinance constitutes an emergency in that it may <br />save the City from further expense and possible litigation in that it <br />provides for the immediate settlement of said claim, and in that it <br />provides for the usual operation of a municipal department, now, there- <br />fore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br />OHIO: <br /> <br /> Section 1. That settlement of the claim of Mary E. Rainey in <br />the amount of two hundred dollars is hereby ordered and authorized, <br />conditioned upon the execution and delivery by Mary E. Rainey of a <br />full release in favor of the City of Lakewood, duly approved by the <br />Director of Law. <br /> <br /> Section 2. That the Director of Finance be and he is hereby <br />authorized to pay the sum of two hundred dollars to Mary E. Rainey, <br />upon delivery to the Director of Finance of the foregoing release <br />duly executed and approved; and to charge the same to the General Fund - <br />Damages Paid by the City. <br /> <br /> Section 3. That this ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor. <br /> <br />Adopted:..Octo~er 20, 19~8 <br /> <br />Thomas C.
